this is truly a sad incident. On FB, it was mentioned that the guy had reached down to grab some food, took his eyes off the road and went into the yellow line.

 

There was no mallice or ill intent. This was just a sad accident.

That's not an accident - it's criminal negligence.

It is terribly sad, and as a cyclist and family man myself I can only imagine the immense pain and sene of loss the family must be dealing with.

 

I agree with Slowbee though, it is highly likely that this is an honest accident. Don't even tell me for one second you NEVER take your eyes off the road when driving?  I mean, seriously, are you concentrating at 100% capacity, for 100% of the time when you drive your bakkie? You never look down to adjust the radio, or turn up the aircon temperature?  You never look down to pick up your protein-shake-epo and take a sip?  And you have obviously never been in the wrong in an honest car accident, even when there has been no loss of life.

 

All the above is very legal to do, not breaking the law.  Accidents happen all the time.  So I suggest we all get off our high horses and you with no sin cast the first stone!

 

It is unfortunate and very sad that our beautiful sport is on the short end of the stick when it comes to accidents though.  But we are sharing the road with machines that is many times our size.  P=mv

There's no excuse for taking your eyes off the road and then drive into a cyclist.

Although I agree with you, it does not make this an innocent accident which of course, will never see the light of day..  Somebody lost a life and therefore there SHOULD be a full inquiry.

Unfortunately this never happens, ever, ever.

Has anybody been convicted for anything after hitting a cyclist? 

Just asking.

So sad. RIP fellow cyclists. Something will have to be done. I was hit from behind by an "alleged" drunk driver in October last year. He did not stop. I was lucky to survive . I suffered an cracked pelvis, broken ribs, ligament and soft tissue damage. A few motorists(eyewitness) stopped to help and gave their details to the Traffic personal that responded. One motorists even gave chase and got the registration number of the vehicle. To make a long story short....after a few attempts the SAPS eventually got back to me. Apparently there is no information on the file except my name, cell number and a registration number. No names and contact details of the witnesses. In the meantime I am suffering from serious back problems that is according my doctor as result of the accident.

Was this on the Botlery road the morning of the Burger road race, if so I know who stopped and help you first on the scene. Yes he was drunk and we locked him in the vehicle, other wise My mate would`ve really caused him harm.

when you are driving you are driving - you stop looking where you are going to do whatever you are no longer driving and that's enough malice for me

 

until they lynch one of these murderous cretin drivers we are going to continue to be killed and no one cares

 

all we need is one example stuck in jail for ten years and suddenly people driving will sit up and pay attention to what they are doing and not muck about in their cars

 

not a dig at you slowbee just a shot at a feeble excuse yet again from a killer driver

 

Malice needs intent and we don't have that here.

 

We have criminal negligence on the face of it, and but for the grace of God, there go I (which is a neat trick for an atheist).

 

There's times when I'm distracted and things happen.  I've not had an accident in over 20 years; but I did have a very irate moped rider to apologise to when I turned right once and really didn't see him. 

 

I would have been culpable but 99.9% of the time, us criminals get away with it and nothing happens when we're distracted / not looking.

I don't agree at all. As a driver it is your responsibility to be in control of your vehicle at all times and to drive in a manner that avoids accidents. If you take your eye off the road - whether it is to adjust your aircon or pick up a drink - you're not in control and are driving irresponsibly. It is irrelevant whether I or anybody else have done it. An accident happens when something unforeseen occurs which is beyond your control. Such as if a cow or dog walks across the road or you have a blowout, hit a pothole in the dark or similar. If you bend down to pick up food or a snack off the floor of the car, you relinquish control of the vehicle and should foresee that you will not be in control for those seconds it takes until you sit back up and resume driving normally. Anything could happen in that time. I say it again, that's no accident - it's criminal negligence

Good point, but we are all negligent, and we all get away with it on a daily basis - eg. taking our wandering eyes off the road. It is just grace that we are not in MORE situations were our negligence becomes criminal.

Condolences to the Family, and my thoughts especially is with the little girl, now without a father.

 

We are once again on the Hub, with a two wrongs make a right argument.

If the driver indeed did reach down and take his eyes off the road for chow, he is in the wrong. I can assure you, the guilt this person (if he is of sane mind) is going to feel for his negligence is a huge punishment.

 

I agree that cases like these should be investigated and prosecution to the full extent of the law should happen. Perhaps this does not happen unless a case is made by the family?

 

BTW, I was rear ended in my car the other day, luckily only a bumper bashing at low speed, but guess what? The lady "put her handbag on the passanger seat floor, as there was a beggar at the traffic light. ( She had her eyes off the road completely, as I was watching her in my rearview mirror.
