Glad you are ok!

 

Can you perhaps draw a picture with the lanes and cars and you and the directions? There is a reason why they ask on accident reports to draw a picture, in that words can be interpreted differently.

And add the jay walking pedestrians to the list.  You hit them and crash into a car stuck in traffic then by rights you are also at fault.

I like the fact you say jay-walking....it is amazing their attitudes as if to say that you have brakes so you must use them and then keep walking in front of you.

 

I have had a few close calls with jay walkers...a few of them being smaller school kids running between cars.

My opinion: Never admit any % of liability. Report matter at police station for a case number....................claim from your insurance and let insurance do the rest.

Insurance has clauses like " excess" and other excuses not to do what they promise. Although I suspect between the two vehicles we would have exceeded R3k or what ever it is.

 

The driver was very polite and apologetic: drove me home, and called a few hours later to see how I was. Certainly went against my stereotyped thinking of Taxi Drivers. Yes, we swapped numbers but haven't gone to traffic dept etc because we won't be using insurance claims.

In my experience even if you won't be using your insurance it is still worth reporting the accident for peace of mind and in case of future complications. You never now if the other party might not follow through with what they say or decide on a different path #UseItDontUseIt

There wasn't one eddy, however one does emerge about 50-100m after the accident point. I've never understood the thinking in this area: they have dedicated lanes in parts, then not even a shoulder in others!

HI Guys & Girls

 

This morning I was in an accident and I thought you'd all like to hear about it, and I have some questions for you all.

 

It was in morning traffic, riding on a trafficed road, with stopped traffic in both directions. There was no shoulder and so I road down the white line.

 

A taxi was wanting to U Turn, and was indicating right to do so, and a car let him in by indicating, flashing etc. The taxi turned right as I was coming past it and collected me in the process. Other than some bumps and bruises the big damage was to the taxi's right wing mirror and my bike.

 

Who is at fault?

1. Me for riding down the white line rather than the left edge of the road (there is no shoulder)

2. The Taxi for not looking if it was safe to cross

3. The on coming car for implying it is safe for the taxi to turn

4. No one

 

I now have a taxi driver on my case to cover half the cost of the wing mirror, a bike demanding a new derailer (Campagnolo Athena), a bent bike frame, and a suspicious rear wheel.

If it was a solid white line then the taxi was making an illegal turn irrespective whether you were there or not and is responsible for the consequences of that act.

 

Hopefully you were on the left side of that line because if both of you were committing illegal maneuvres then the responsibility for the accident is much more difficult to isolate.
