CLUB GROUP RIDES

My club prouds itself on it's weekend club rides and advertises it all over as being safe. Safety in numbers 

 

The club further uses it to lure potential new members to the club.

 

The ride is promoted as being safe as there is a motor vehicle behind the bunch for protection

 

I go on an organised club ride on a Sunday morning to whereever.

 

During the rides the bunch splits and there is no longer protection from the accompanying motor vehicle from behind for the faster group.

 

In this process I get knocked over by a car due to no fault of my own while cycling in the front group. In the process I suffer severe injuries and spends weeks in ICU and months in the hospital.

 

Do I have any grounds to sue the club for damages as they failed to ensure my safety?

 

What other grounds do I have if it only later comes to light that the rides were not legal due to the absence of proper Traffic Authority approval to host an organised sports event?

 

In the absence of traffic authority do I have a right to claim from the mororist as I was forming part of an illegal sporting event on a public road.

 

I have also not signed any indemnity to the effect that I will not hold the club responsible should anything happen to me.

 

Another scenario is where one of the fellow club members ride into my bike or fall on my back wheel and break it during a ride. Can I claim from the club or my fellow club member?

I think most clubs have a statement that you are riding with them at your own risk. Even though they have a vehicle behind. And if that vehicle doesn't have signage on that there are cyclists ahead, a vehicle planning to overtake it might not see the cyclists.

I dont think it is the clubs fault:

 The car hitting you had nothing to do with the club.

There was only one following backup vehicle, you know this, the bunch split, YOU decided to go with the front bunch and not the slow guys and back up car.

A club ride is not  a sporting event or a race (no entry fee, no specific start and finish, no timing, no winner)

 

Cycling is dangerous, less so with a club but still dangerous.

Invest in an indoor trainer its much safer, you and your mates can then organize a group indoor trainer ride. No back up vehicle neccesary.

Best is to consult with a lawyer but I (not a lawyer) can refer to a case whereby someone on a spinning bike excreted himself more than he should have and ended up with some ?pulled muscle?. He tried to take the gym to court because he felt that the spinning instructor by means of peer pressure ?forced? him to spin harder than he should have. He lost the case.

Why? -  because in court the question that will be asked is ?Were you forced to ride or did you join the ride voluntarily?? and if the answer to the latter is Yes then you have no leg to stand on as the legal fraternity will reply that it was your choice as you had the final say which is Yes or No.

1. dont buy an indoor trainer

2.sell your bicycle

3.go to "toys are us " and buy a foam football

4.go to a psychiatric hospital and they will let you use a padded room to play

5.stop trying to find blame in others for stuff that has not happened

6. get counseling

8. get a life

 

and to the rest of you who actualy justified this crap attitude with a reply ....stop!

There are 2scenario's at play here...a common law liability if your fellow riders actions resulted into loss or damage to yourself and potentially a vicarious liability attaching to the club who may well have alluded to ensuring your safety  Delgado2007-05-08 06:09:08
