@JGR - it was an image I took, which had my logo embedded on it... so someone intentionally removed my logo and claimed ownership

Before going off half cock and invoicing, more often than not it's best to speak to the guys concerned first and then arrive at an agreement.

Also be very clear in your terms of image usage when quoting for a job.

Thanks Danger for the links. Didn't rush off and invoice (knowing that need to first find who is responsible). Traced things back to whoever is sending out news releases, and manager is in town, so will have a polite conversation with him tomorrow. And no images were not shot for the team, but for the event rather!

I was referring to Tiny K image - much the same as the IM 70.3 video showing about 10 secs of me. I dont have a leg to stand on but you have been cheated. I would send a bill but also something to protect yourself (or enrich) agaisnt further use. I recently had to purchase some stock photo's - why not check out Istockphoto or similar and get fair pricing - maybe their terms and conditions would also help you with some of the legal distribution stuff.

I have to admit, I have done that before but not for commercial gain. Photo that was taken of me during a race.

 

My understanding of the law in SA is as follows (disclaimer: I'm not a law expert or professional photographer, so please investigate further).

 

If someone's image is to be used for commercial gain (i.e. to be sold) then a model release form is required from said person.

This is not the case if the photograph is to be used just for editorial purposes (i.e. newspaper report etc).

 

TinyK - I assume that you didn't sign a model relase? :thumbup: So, if the image was sold to someone, in theory you could ask that pic be removed. Or alternatively, you could tell the photographer that in return for a signed model release form you would like a copy of the image for personal use. Win-win for both of you...

Does the site where they took it from state that content is copyrighted and IP, if not its fair game, if it does, take a screenshot of their site, send them your terms and conditions from your site, along with an invoice for a couple thousand K.

Its a legal opt out trust me been in this business long enough, A you need to have it noted on the site that the information is intellectual property and copying of content is regarded an infringemet, B you need to be able to prove that the content is yours.

 

Any moron can take any picture of the internet and give it a watermark, what we do is timestamp the files that we own, place it on a memory card and mail it back to ourselves that way it can be opened in a court of law, with a timestamp that cannot be questioned.

 

Even if its his picture and he cannot prove ownership beyond any reasonable doubt there is nothing he can do, and if its taken of a site without any notice of Copyright/IP its legally fair game and may be used for distrobution as there is nothing that indicates the contrary, common decency does not apply here.

100% agree - unless the site or photo specifically states that copies may be used, then it's definifely not ok. Anyone using photographs they did not take should understand that the owner has a copyright and needs to grant their use.

 

I tag most of mine with a "Non commercial, attribution" license i.e. anyone can use them for non commercial uses as long as they credit me, but if it's commercial than they need to pay for the rights.

You do know that timestamps, along with anything else in the digital world can be, um fiddled with.
