Cycling without a helmet in GroenKloof!!!!

My 2c is that if he gets hurt, then Groenkloof somehow gets blamed and next thing we know we can't ride there anymore.

Tell him to get a helmet next time I say

 

I like this answer. In the event that something happens and Groenkloof gets screwed legally, then our riding there could be in jeopardy.

Correct. They did not stop him from riding and therefore they did not exclude themselves from liability (I will quickly find out).

 

Edit: Okay yeah, Groenkloof may be held liable if someone is not stopped when riding without a helmet, since they are not enforcing the rule (100% of the time).

 

Are there signs up saying no helmet no ride? If so, wouldn't that absolve Gk of any blame? Realisticly speaking can they check every single person?

Yes there are signs, it's also on the website.

Thing is, they're supposed to enforce it. From a legal standpoint I was told that failure to enforce it would hold Gk negligent.

I disagree - he wears cycling shoes and cleats, not tekkies. One would expect him to have a helmet as well.

I havent been there but I assume there is one entry and exit point (after making payment)?

If so and the rider was allowed to pass through with no lid on his pip then I think they could be held liable.

If he passed through with a lid but took it off on route then I think its a different issure.

There's a sign as you drive in, clear as the Voortrekker Monument: no helmet, no ride. Have not seen or signed a disclaimer though. You should be made to sign as you enter.

Aah - it's a pity that GK could be held liable even though there are signs and people choose to ignore them. I agree that they should maybe monitor but sometimes it's not possible. I guess payment could only be accepted upon presentation of a helmet..

i agree that riding there is subject to wearing a helmet by the rules of the reserve. however all the guys suggesting that he's gonna fall and spill his grey matter all over the trail... that's a bit OTT

 

there's riding and there's riding. if you take a rustige chill ride with the girlfriend, missing all the technical bits, its probably a LOT safer to ride without a helmet than trying to do jumps and crazy fast downhills with one...

 

I think the cycling community should be more concerned about guys littering their gu sachets in the reserves. chances of them closing it down due to litter is greater than some oke with a concussion.

+1, in saying that the rules of the park should apply, as others have said it could potentially have far bigger consequences if he was to fall and hit his head.

I caught up and passed above mentioned uncapped couple at Groeinies on one of those first detour mtb paths from the tar road, where they were meandering very slowly. The path wasn't too technical, but there was a few rocks to stall a slow moving wheel and send the rider face planting .You don't know what you don't know!

 

Friend of mine in CT bought a mtb on my advice, not really used much after a first ride down to the shops, where she went over the handle bars after yanking the brakes, narrowing missing connecting her cranium on the curb stone. She had no idea discs could be so sharp. She was not wearing a helmet (didn't own one at that stage) I got the feeling she didn't like the concept of a helmet mainly due to aesthetics.

Reasons to be concerned about others not wearing a helmet:

  • If they crack there pip, I will render first aid when I pass, that will probably screw up my day
  • If they crack there pip, their medical aid, which I may also be a member of will be faced with large bills to pay, making my/your medical aid more expensive
  • if they crack thier pip and are not on medical aid, my/your tax will pay for his ambulance, treatment etc which could rather be spent on better things

Choosing to disobey laws and safety rules does impact on others and is not a victimless crime.
