Dr Koos Roux hit & run suspect court date : 29 January 2014

A representative from Pedal Power was at the court on the 29th and a reporter from the Tygerberger has expressed interest in publicising this. I've put the two in contact with each other and asked if they can keep both the public and cycling community informed as the case unfolds.

Not much else, he was charged on 4 counts, pleaded not guilty to them, but still got found guilty on all four.

Apparently there was sufficient evidence to prove his guilt.

CH only?  It should have been Murder!

At least it is a conviction which has NEVER happened in the past.

The sentencing is normally where all falls flat.  Hope he gets hit hard but history is not in our favour.

I know of cases in the past (well not hit-and-run but drunk driving) where accused was found guilty but then they end up with suspended sentences or house-arrest sentences.  It's like giving a naughty kid a playstation while standing in the corner of the room.

Agree

 

I hope he gets a custodial sentence (tronk) and not a suspended sentence or a fine

 

At least, he has now a criminal record.

Hope he gets hit hard, but legal precedent is not in our favour here. In a fairly recent matter, 2010, a guy was found guilty of CH where a person died due to his negligent driving. He was initially sentenced to 3 years in prison which got overturned to supervised house arrest (I believe for 3 years) and 16 hours of community service per month for the time of the sentence. However he could still go to work etc.

Sounds like the Magistrate did not believe his BS, and stated that he showed no concern for the victims when he fled the scene.

Let's hope he gets more than just a rap on the knuckles.

Let's see what happens. Maybe we'll be surprised and he will get a sentence that gets slightly near what's deserved.

 

At the end of the day he is a killer, his record for life will be marked as a killer, people will know him as such and he will have to live with his actions (though by what he's done already it seems he's pretty okay with that). Hope they come down hard.

He pleaded guilty, makes sentencing a lot easier. 

Still got a BS sentence, though.

Dr. Koos se vrou tevrede met uitspraak

Dr. Koos Roux (59) se vrou, Beth, was Vrydag verheug maar ook verbaas toe die man wat van haar man se dood aangekla is, ná vier jaar skuldig bevind is. 

Geoffrey Merrick (54) van Brackenfell is in die landdroshof in Kuilsrivier skuldig bevind aan strafbare manslag nadat hy Roux met ’n voertuig van sy fiets af gestamp het.

Die ongeluk het op 12 Mei 2013 op die Bottelary-pad naby Kuilsrivier in die Kaap gebeur. Roux en sy seun, Kobus, wat toe 19 was, is raakgery. Roux is op die toneel dood en Kobus het ligte beserings opgedoen.

Landdros Abdul Kader Jamalie het Merrick skuldig bevind aan strafbare manslag en drie ander aanklagte wat verband hou met die oortreding van padveiligheidswette.

“Merrick het nie ná die ongeluk stilgehou nie. Hy het ook geen belangstelling in die beseerdes getoon nie. Hy het op al die klagte skuld ontken.”

Jamalie het ook gesê die getuies, waarvan Kobus een is, was geloofwaardig. “Daar is ook genoegsame bewyse wat daarop dui dat Merrick wel op daardie dag en ten tyde van die ongeluk op die Bottelary-pad was.”

Beth Roux het ná die uitspraak gesê sy het nie verwag dat Merrick skuldig bevind sou word nie. “Oor die vier jaar het die verloop van die saak my negatief en soms positief gelaat. Maar ek is tevrede met die uitspraak.”

Sy sê sy verlang steeds na haar man.

Die saak is tot 21 Augustus uitgestel om ’n korrektiewe verslag en ’n verslag van Roux se familie te bekom.

Merrick se borgtog is verleng tot 21 Augustus wanneer die saak weer voor die hof is vir vonnisoplegging.
