It doesn't matter what you buy, the CPA protects you. They are the informed experts on what they selling and should have advised you on the pro's and con's.

 

If this goes to court they will loose !!!!

Is 110kg that heavy, especially for a South African! My GT avalanche was bought when I weighed about the same, wheelset did well over 10,000km with only a spoke that broke! I dont treat my bikes like crap but they are mountain bikes after all and do get ridden in the mountains!

Good point, however, I have seen a number of entry level MTB's from Schwinn with all the bells and whistles and just above the BB a little sticker warning you not to ride that particular model 'off-road'?

 

I think he just got poor advice and service at the time of purchase!

But dude, it's an entry level bike, the cheapest niner in their range, and not really built for MTB of any kind.

 

Think of it (and all other bikes in this segment) as the beachfront cruising to the shop and back kinda bike.

 

Yes, the guy should have told you that you were too heavy for the rims. But knowing Solomon's, he probably didn't even know that to begin with.

 

Instead of railing against momsen (who have given you a way out by having a new set of their imported rims) rail against Solomon's for giving you crap advice.

If by "they" you mean Solomon's then yes. Momsen did not sell the bike. They bear no part on the transaction. It's Solomon's who need to come to the party.

 

But in terms of the CPA this doesn't qualify. Afaik it's too low a level of "loss" as its only one rim.

110 kgs is not that heavy if you have the right spec bike. But you cant expect a bike or product that was designed as a recreational cruiser to perform like a MX bike.

It would depend on what the customer said he wanted to use the bike for. There is a reasonable expectation that it should be suitable for the customer's intended usage.

 

Also, Solomon's act as an agent on this. Momsen offer the warranty.

I suspect you threw your toys out the cot because the LBS sold you the wrong bike and now you want Momsen to sort it out for you ?

 

Not at all, I can assure you of this, I asked them on FB after mailing them 3 times, why they do not respond to emails All i ask for is advice. My second post was slightly more aggressive and I said fine if this is how you respond, by deleting posts that might reflect negative do it. there are other places I can inform people of your lack of service.

 

Might have upset them slightly but still I have received no response no reply email or anything. If they replied to my first email I would not even have gone to FB and if they simply said wow sorry man please send me you contact details and someone will contact you I would have appreciated it and still speak good about them

Yeah true, but momsen can't be held responsible for Solomon's stuff up, as they're only an appointed agent. Same as if ABE supply flooring solutions to a contractor, who stuffs up the prep and the floor goes bad. Client goes after the contractor. If the batch of flooring stuff was bad then the contractor goes after ABE. but ABE sends their specialists to do a core sample, or in extreme cases rip up sections of the floor to determine fault of prep or product.

 

In this case it's fault of the advice, hence Solomon's.

Read 'em again. In one post you say you asked for an alternative which they gave, but you felt it was too expensive. Then in another you say you asked, but was ignored.

I say it's the cheapest 29er in THEIR range, you say not true you could get a cheaper one somewhere else. Not quite on the same topic there.

 

I SAY THIS: I agree that even if someone is wrong, and dealt with it like a chop (note the "someone") a dealer must always be respectful of the customer and his or her own brand. The problem here is Solomon should've gone the (possibly) awkward route to recommend upgraded rims or wheelset for your weight or at least have informed you so you could make an informed decision. If there's a weight limit on those wheels or rims and you were not informed you can CPA them. But YOU bought the bike from THEM and not from Momsen. Slating Momsen seems a bit out there.

 

I have done one warranty with TWT and have been involved with another.

 

1. Prologo saddle

Bought one new and after a short period of time the saddle showed excessive wear. IMO. Via my LBS, they asked for pics and then sent me a new one without any hassle. Didn't have to courier the saddle to them first, no arguing. Straight FOC replacement.

 

2. Friend's Tomac had a crack on rear tri

Crack was discovered post ride late afternoon. Took some pics which I forwarded to them. THE NEXT MORNING I received an email forwarded by them to me from the factory saying a rear tri will be flown out THAT SAME DAY from the states. Bike was back in action within 7 working days.

 

Excellent service I would say.

No, it isn't. The bike company has to honour the warranty on the components specced on their bikes too. In Momsen's case this warranty is one year, apart from the drivetrain.

I bought a Specialized............the wheel cracked, the warranty was honoured by Cool Heat (the Shimano importers). I wasn't happy with the wheel I got. I went directly to Specialized who told me that there was nothing they could do as they were only liable for the frame. I addressed this with the bike shop, who confirmed that this was correct and almost all brands worked in this way.
