What are my obligations. I want to be fair.

I sold a set of xpresso 8 carbon pedals (still in the original metal box) they were 2nd hand when I bought them and still in good nick. Tried road riding and just never really grabbed me. I probably did about 400 km on the pedals.

 

So I sold everything road related. The guy who bought the pedals was in kwa Zulu natal . A friend of my brother in law was doing the amashova so he took them with him. Them met up on the Monday after the race as said friend took to long to finish and the buyer understandably didn't want to hang around.

 

The buyer then met with friends wife on Monday 13 October as he had to fly back on the Sunday after the race.

 

I then received an email from the buyer on the 22nd of October telling me there Is an issue with the pedals. Emails attached.

 

What are my obligations towards the buyer. If the pedals are in the same condition. Should I be prepared to sort out the issue. Or should I give him a refund.

 

He really is seems to be a nice enough guy and want to be fair. My only concern is how did the pin just come half the way out and why wait til Wednesday to then tell me. He has taken them to a bike shop and has been told that they have to be sent to J&J and that the play inside the pedal he thinks is that the bearing has gone.

 

What's fair play in this situation ?

Sorry to bother there is a problem with the pedals I got from you ,I was so chuffed with them, Then when I put them on the bike on Friday and rode with them for the 1st time I had two problems with the left pedal, in my ride the adjusting pin for the tension on the pedal came out but I managed to get it back in ,then there was a noise on the pedal most of the way and when checking what the problem was ,the pedal has a lot of play on it to the point that I cannot use them.

I am not sure if this can be repaired or not, what are your thoughts ?

Sorry to hear that. I never adjusted the pedals at all from the time I got them. I really never had any issue's with them at all and am gob smacked that you have. As my technical knowledge is basically nothing I wouldn't know if it is something that can be sorted out. Let me speak to someone who has a far amount of knowledge about everything bike related and see what his thoughts are.

 

How come the pin came out,did you loosen it to far? Could the play then not be from something

Relating to that,as there definitely was not any play before. In fact of all the pedals I had before these were by far the most comfortable with the very least amount of movement .

 

Let me find out about repairs and what could of gone wrong and will revert back to you.

 

Sorry for the hassle and am disappointed that somehow the pedals have let you down.

Thanks I done nothing just put them on my bike and rode with them and at a point i was battling to clip in and out and that’s when I noticed the pin was half way out, then on checking further when I got home found allot of play on particularly the Left pedal ,as far as i understand there is a bearing inside that could have gone, no idea if this can be replaced.

I have a set of the Express 6 and when comparing them there is a problem.

I would cut my losses and refund him. Get the pedals back and have it repaired.

Sticky situation. Do you have a pic before you sent them. It could be just bad luck that they failed on the bloke. Really tough to say. Depends how nice and accommodating you want to be. Tough one really. Good luck.

The pedals probably only require a service, which in this case I think the buyer must pay. If someone buys a 2nd hand bike and then realizes that it needs a service, you can`t go back to seller expecting the seller to pay for the service.

 

If it is a more serious problem then the pedals should be replaced or fixed under warranty.

Refund it is then, will sort out from there and resell. I know could say not my problem but the guy is a gent. So prepared to sort him out. Although can't get a hold of him now.

If the roles were reversed ,I would be well pissed if the seller told me tough luck 2nd Hand item. Have bought items before and it wasn't what I thought it was ,*** feeling.

Under the Consumer Protection Act.. All goods are sold in a good working condition..

 

And the rules are the 3 Rs, Refund, Replace or Repair..

If buyer is happy to have the pedals repaired then you should consider paying for the repairs. Otherwise get him to return them and give a refund. In the long run if you will buy and sell more stuff here it is forward thinking to maintain a good reputation.

Granted I understand the good rep thing ,albeit the guy is not a hubber as he contacted me through email & cell .But for me more importantly is that the deal is fair for both parties and if it really is a case of bad luck and timing when he purchased the pedals, then he rightly would deserve a refund. If it were a month later and 500 Km's different story.

 

When I meet him later I will gladly refund his money,and reassess the situation there after. As long as the pedals are in the same condition and he hasn't fallen with them ,which I doubt very much.

 

And he's seems to be a genuinely good person.

The CPA doesn't apply here unless the OP is actually in the business of buying and selling goods. There is no obligation to refund and he is only doing so because he is a decent person.

After speaking to the buyer he wants the pedals to be sorted out rather than a refund. BUT NOW I FEEL THERE IS AN ISSUE ! As he was here in jozi he left the pedals with a friend of his at a nearby hospital which I then went and collected.

 

So i took the pedals to my local and asked the owner for his opinion . He fitted the pedals to a crank and showed me that there was no play on the left pedal what so ever. So we then fitted the right one as well ( which the buyer never complained about) and there is ever so slight play . He suggested he is talking about the float.

 

As for the adjusting pin that the buyer has complained about,essentially it's a camber pin? ( can't remember what they called it) that turns and only has 2 settings, which basically determines easy or hard for clearting in and out. This camber pin does NOT screw in & out as the buyer suggested . And is not even loose or Close to coming out. And he has hacked at the left one as you can see from the pics. I am presuming he wanted to adjust the tension.

 

I then took the pedals to my other local and basically got the same story.

He received the pedals with 2 sets of cleats and they have returned with only one set for some reason. And not the newer ones either.

 

I haven't spoken to the buyer as yet but feel a little aggrieved by the whole saga now. I want to give him his money back and just move on ,but the pedals are not in the exact same condition as he received them in and he has a set of cleats.

 

Where to now? We are only talking R800 for the pedals. Should I just be done with him and refund or take a stance.

Ive hand a similar issues with those pedals if that in conciliation - strangely also the left. Lots of play and a speaky noise.
