Buyer doesn't control the sale.

 

Seller controls the sale.

 

So seller gets to decide whether or not to accept dibs.

 

So if you see an ad where another buyer has called dibs and this hasn't been publicly corroborated by the seller, there's nothing stopping you from contacting the buyer to find out more.

Strangely enough, I've never had anyone call DIBS on my ads

 

I ask them to PM ME directly

 

Pretty much ignore any other comments that is public

 

The Private Message reflects serious intention and interest to deal/buy/transact

Actually, neither controls the sale.

 

The sale is subject to the very simple Law of Contract in South Africa as the Hub does not operate outside the South African Legal system.

 

The Law of Contract deals with AGREEMENTS that bring about legally enforceable rights and concomitant obligations. At its simplest form it therefore  requires both an agreement between two parties and an intention to be legally bound by it.

 

How does shouting "Dibs" constitute an agreement ?

 

 If someone tells you he has a claim based on "dibs" tell him that even if he invokes the   "Wingardium Leviosa"  charm, it will not fly, unless of course he resides in Hogwarts. In which case tell him that you have mastered the "Expecto Patronum" charm which provides you with a defence against Dementors and so it would defeat his puny dibs in any event.

 

Then tell him to fork off.

Dibs is BS.

The first person with cash in hand gets the deal.

 

Express your interest, and arrange for payment as soon as possible. If you can't trust the seller, or need to do your homework first, based on your impulsive nature alone you probably shouldn't enter the deal anyway. I have lost out on deals before because I had to research the product first. At the end of the day I am still better off without spending money just because it's cheaper or on sale.

If I place an advert and have 2 interested buyers, one who'll get in his car and drive 50km tonight to secure the deal, or another one that calls dibs, but can only make it somewhere over the weekend, he either has to EFT the funds asap or lose out.

 

My time is also not for free and keeping me waiting coz said buyer first had to stop at Goede Hoop slaghuis will most probably go home with just his boerewors.

I go with dibs on the hub. It's a community here so there should be an element of that good will and not just the first to appear at the door with cash. It's not gumtree. 

 

I sold something a few weeks ago to the first guy who contacted me. He had some hassles, I didn't ask for a deposit and he only picked up about a week or so later and paid me then. He was super stoked and really grateful that I held the item for him and we both came out of it well.

 

It the time between I had people hard hassling me, calling me out for not selling to them, trying to offer me more and even getting angry at me for not giving it to the guy with the cash even though he might have been 10th in the line. 

For me I'll keep my word and if you're first in then kewl, i'll work with you. If it doesn't work out I'll relist or contact the next guy but try to do the right thing here so that others will do the same. I've always had great interaction as a buyer and a seller so I want to keep that feeling up.
