You shall at all times ensure that any content posted by you on Bike Hub or any Website forum shall not:

  • be unlawful, defamatory, offensive (such as profanities), sexually explicit or pornographic, abusive, threatening or harassing, intimidating, or racial, religious or personal attacks of any kind;
  • violate the property rights of others, including copyrighted text, images or programs, trade secrets or other confidential proprietary information, and trademarks or service marks;
  • contain or carry any code or electronic information of a malicious or destructive nature or that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information of Bike Hub Users;
  • advertise or promote chain letters, charity requests, petitions for signatures, employment opportunities, investment or savings opportunities, requests relating to Ponzi or pyramid schemes or any other content or information that creates and distributes unsolicited commercial communications;
  • impede the operation of Bike Hub website or service infrastructure or that negatively affects the availability of the Website or the service to others;
  • be false, inaccurate or misleading; or
  • violate the terms of this Agreement or any applicable law, statute, ordinance or regulation (including, but not limited to, those governing consumer protection, data protection, unfair competition, anti-discrimination or false advertising).

 

If you're arguing the bold bit, Fair Use (which this comes under, in my laymans understanding) does not infringe on the copyright of the original poster / picture taker, given that it's being used in a way so as to provide commentary / critical analysis of the actions of the people in the pictures. Forum rules do not override that tenet, though the owner of a forum reserves the right to delete / moderate any picture / article / content that does fall foul of the copyright rule. Those are 2 separate issues, though. 

 

Defamation also isn't an argument, as for that to be true, the assertions need to be false (amongst other things, but that is the main one in this instance)

 

I ask again - WHY the legal attack? WHy not just own up and say "yes, they did it, we'll handle it internally and endeavour to correct these actions in the future"? 

 

EDIT: This smacks of an attempt to quash any negative commentary towards this club in particular. In the states, this could be classed as a "slapp lawsuit"

so calling club members out for riding "recklessly" is not allowed ?

if you feel the members are innocent then why not post a deffence rather than launch an attack, this tastes to much like guilt to me.

 

This is the problem with people today, no one will admit they made a mistake and say sorry, theyd rather turn around and attack the accuser.

It why we as cyclists have such a bad name. Ask anyone on here and they'll tell you, when you call out a fellow cyclist for doing something wrong there is a higher probability of getting sworn at than getting an apology.

 

 

And whilst this attack is on your particular group, the reckless attitude and riding proliferates many a cycling club/group in all areas of the country. i see it everytime I ride.

 

As someone else has mentioned, This is why I ride alone.

Does anyone else remember the WHITE BAKKIE from Durbanville that nearly hit a few cyclist?

 

The driver apparently told a cyclist, they think they own the road.

 

I personally had a VERY close call on a Sunday morning on Spes Bona road.

 

He came past us and I could feel the wind of his mirror, and he must have been doing in excess of 120kmh

Indeed. Or, with people who respect the road rules and other road users as I do.

Amazing how some can defend the dville club’s actions and kind of laugh it off. Trying to justify standing in the middle of the road is beyond me. What a way to make a name for yourself.

There would be literally millions of photos on social media of cyclists and other people that took photos while standing somewhere on a quiet country road (and did not get killed in the process).

You are wrong once again, those pictures are within a group on Facebook where these people gave their consent and is protected by copyrights. On Facebook these people are also not being battered.

 

You have actually stolen these pictures and then battered these people without their consent and or knowledge.

 

As i said your ego seems to be bigger than your IQ.

Just because a member gets under your skin, does not give you the right to attack them.
