In this case though liability rests with the third party (they have admitted as much by offering a settlement) so the NCB remains in place if a successful recovery against the third party takes place. There is no TP pending claim against his policy. The OP should be using the legal department of his own underwriter to strengthen his case for the TP to accept full liability. Insurer to insurer direct communication and courtesy carries considerably more weight than Joe Soap's layman-type correspondence. Running a red light or stop sign carries full responsibility. Any half decent lawyer would smash their naked attempt to take advantage of the OP's vulnerability..

  9. Two simple simple lessons here: Direct insurance is poison, and cheaper is not cheerful. Do your homework when looking for cover, look at the pros and cons of each quote, and automatically exclude the cheapest option. (it's cheap for a reason). I advocate ALWAYS using a broker. Smaller brokers give better service than large corporate brokers. Their knowledge, support and clout during times of difficulty is PRICELESS. Remember brokers want to retain your business, whilst insurance companies are driven by numbers. There are good brokers and good insurers out there, you just need to find them.
  10. Try posting a wanted ad in the classifieds bud. Willing buyer/willing seller principle applies. The ad stays there for 30 days, whilst a thread disappears almost instantly if there is no interest.
