False Advertisement

Hi Guys,

I hoping someone here can help me out here?

I recently purchased a road bike on the hub website.

I am in Durban, the bike is JHB.

I only viewed the bike over the internet.

I did not view the bike personally but from what I had seen and what was described in the advert was exactly what I was looking for.

The bike was advertised to be a medium and it even gave me the measurements from BB to Seat clamp (50 cm).

Perfect frame size for me.

When the bike arrived I was really shocked to see that the bike was NOT a medium but a medium/large (54 cm).

The bike is now too big for me!

I feel so gutted that someone could falsely (even if by mistake as this person claims) advertise a product and not accept any responsibility. (The seller is refusing to accept the Bike back and give me a refund)

What would be the best way forward? Do I need to seek legal action?

Has there been anyone on the hub that has had the same experience?

I can’t be the first one to have experience this.

What can I do?

Thanks!

Name the person and we will validate it and tell you which route to follow. :)

Even if it was a mistake I would refund the money to the buyer. What must you do with a bike that is too large? You cant use it.

As far as I know a 54cm is a medium, not 50 cm.

Perhaps you should report the incident to the moderators as well. I'm sure there must be some rule as to correctly describing the goods one advertises.

What is the grounds for the sellers refusal?

Ps: 50cm is usually considered a small, 54cm is a medium.

Pps: agreed bring the seller here, maybe we can talk some sense into him/her.

Unless it's a Giant, where medium is marked as 50cm on the seattube (54+ on the TT).?

His name is marthunis Jacobus

Profile name : Tinus.d

The frame is a Giant compact frame. It even says ML on the frame! I dont know how any one can sell it as M???? From the advertisemnet one could not see the ML sticker. And on his adevert it said M and 50cm. Complete Lie!

It clearly states M and ML

I have even offered to pay courrier services to send the bike back and he has refused!

Please if anyone can give some advice on this, it was my dream bike and had to borrow the money to get it.

Thanks
