MTB Instructor sued for 4 million Quid!

the terms he used were "slope, dropoff, bombhole" - which are 3 totally different things. 

 

I *think* it's just a section which is slightly slopier than average, and has a gully section. Sort of like a bomb-hole, but FAR smaller. 

 

A bomb-hole is a piece of terrain that is almost literally as if a bomb had hit the ground and left a divot. Slope in, depression, climb out. If taken at speed, it is quite a difficult feature to get right. 

 

I don't see any bombhole on the trail, which leads me to believe that it's just a short steeper section into a slight depression. Which cannot be categorised as a bomb-hole, or a dropoff.

A High Court judge ruled Leon MacLean, the instructor, was 80 per cent to blame for the accident. Damages are yet to be confirmed but are expected to be in excess of £3million.

 

The judge ruled that McClean was negligent in “encouraging” Ahmed to ride “at speed” down the sharp slope without first assessing his biking skills. Describing Ahmed as a “novice rider”, the judge said he “should have been warned” not to take the most difficult route down the hill, the BBC reports.

Wow! Not a very "encouraging" precedent for the instructors out there...

Well, If I was an instructor, I would make sure I have some serious liability cover, or look for another profession.

How do you rule this:

But Mr MacLean had given Mr Ahmed false confidence in his abilities despite warning signs that the hill would be too much for him.

 

Isn't it the purpose of the instructor to instill confidence in his leaner's, so that they can put into practice what they are learning ?

No one forced him to do it.

What a strange world we are living in ..
