    • I only text when I am stationary at traffic light, I know it is still illegal but I pay the fine and it has nothing to do with you.

I spoke to a buddy that drives highway daily.

 

He says he watches Youtube videos when its bumper to bumper traffic and they crawling forward.

 

According to him he still watches the road and his vehicle has "City stop" Function. Sensors scan the road ahead and if collision is detected the vehicle will actually come to stop even if you dont brake.

 

He isnt going to stop doing it

He’s the guy who forgets to accelerate when the traffic moves

 

And the one we will read about on the news one day

eating a big mac, with fries and a supersize softdrink filled with ice is totally legal.

I'm not sure if there's research on it nor do I do fastfood, but am pretty damn sure that negotiating a burger in one hand, stopping it dripping on your lap, getting french fries into the ketchup and then your mouth and slurping some diet coke is probably quite distracting from the task of keeping your car straight on the highway.

It’s been a year since tougher penalties were brought in for using your phone behind the wheel but Brits still aren’t ditching mobiles.

And legal experts have warned the laws even apply to making contactless payments with your handset when the engine is running.

It means pulling up to the window at your local McDonald’s or Burger King and paying with your smartphone is enough to get slapped with a £200 fine and six penalty points if a cop is in the fast food queue, too.

For drivers who have passed their test in the last two years, one offence is even enough for a ban. Other motorists get two chances before they hit the standard 12 points rules

Obviously the "direct interaction with" is grey. A swipe left or right to change a track is not the same as swiping left or right on tinder, as that requires a change of focus to see what you're swiping on. Likewise, it's not the same as texting

 

What are you on about? 

 

Based on the NRTA, you can affix the phone to your head and be busy with it, as long as it remains affixed whilst using it.

Friend of mine told me a while back that A) He is an excellent driver & B) He has been using his phone while driving for years so by now he is very skilled at doing both so really what is my issue??

 

I thought he was a d&ck for saying that but the reality is that most of us have this illusory superiority when it comes to driving (think the stats say 90% of drivers consider themselves to have above average driving skills). Deep down most of us believe we can easily handle a phone while driving despite seeing other people failing at it.

The grey area is only wrt when they can confiscate or fine you.

Yes you can do that, but you can not touch it with your hands and that is clear in the NRTA. 

 

If your phone is mounted to you dash technically you are allowed to touch it (which is stupid and dengerous) but not illegal. I dont see anyone texting like that, they all have their phones in their hands.

 

So the NRTA is clear on when and how you can use it. I fail to understand the problem?

 

Texting while your phone is attached to the dashboard is not illegal and in a gray area.

 

However, watching any video on your phone IS, fixed or not.

 

308B. Prohibition on use of television receivers and visual display units in motor vehicles
(1) No person may operate on a public road a motor vehicle that has a television receiver or visual display
unit in or on the vehicle operated while the vehicle is moving, or is stationary but not parked, if any part or portion
of the image on the screen—
(a) is visible to the driver from the normal driving position; or
(b) is likely to distract the driver or other road users;

Would you feel comfortable knowing someone who believes they are a flawless driver, texting while driving in your neighborhood, where your kids play.
