Long Wheel Base Posted June 24, 2019 Posted June 24, 2019 Exactly. One has a duty of care. Part of being an adult. If u crossed the road eyes glued to yr phone an I hoot but do not brake or try an evasive procedure or both I dare say I would be majorly to blame. It’s how it is. One persons braking the law does not exonerate another’s actionsOff topic but on my Mom's 2nd attempt at doing her drivers license a soccer ball came rolling into the road in front of her. She stopped. The instructor asked he why. She said because a kid will come running into the road soon the fetch the ball. Next second a little kid came running into the road. The instructor passed her and said she needs to practice a few things but because of that he will pass her.
Eldron Posted June 24, 2019 Posted June 24, 2019 On the face of it this seems unreasonable but there are strong parallels with car/cyclist interaction. In the same way that cars have a care of duty to look out for cyclists I reckon cyclists have a care of duty to look out for pedestrians.
Stretch Posted June 24, 2019 Posted June 24, 2019 Did this happen at a pedestrian crossing or just in the road? Is it not "jay walking" if no pedestrian crossing?I've tried to ask this question too. It doesn't say anywhere. If she was Jay walking then it's absolutely disgraceful that he has had to pay
Hairy Posted June 24, 2019 Posted June 24, 2019 she should just not have taken legal action to start with ... feels more like she is just trying to make money of this situation.

Maybe this will get the motorist's attention.
DirtyFrank Posted June 24, 2019 Posted June 24, 2019 I'd knock her.... .....Me too.....target fixation!

At least we know it was at a pedestrian crossing now. Sounds like he was quite an aggressive commuter... As you need to be in a place like London.. But maybe overly aggressive... But then there the claimants lawyer saying that too
Red Bird Posted June 26, 2019 Posted June 26, 2019 So the moral of the story is to get insurance?! ????????♀️
Hairy Posted June 26, 2019 Posted June 26, 2019 So the moral of the story is to get insurance?! ♀yes ... keeps the lawyers in business and ensures they get their paycheck
IceCreamMan Posted June 28, 2019 Posted June 28, 2019 So the moral of the story is to get insurance?! ????????♀️I am a member of british cycling. Insurance is included. When judges start apportioning blame one could conceivably be held liable. Better to be protected. An it’s cheap. Or tack it to homeowners insurance.

IceCreamMan Posted July 1, 2019 Posted July 1, 2019 The incident has certainly raised awareness of the role of insurance. It’s ultimately very cheap for peace of mind. We spend loads on all sorts of stuff. Insurance is cheaper than a pair of fancy socks.
