Yes, but if you walk into pnp your not getting arrested for trespassing. Different access limitations. You need to be granted explicit permission to enter a trail, I don't need to call the manager of pnp so that he can approve my entry.

 

If I walk into pnp it's all good, if I walk onto a trail without a permit I get arrested for trespassing. That's what makes the difference between public and permitted access. I don't get arrested for walking around a public space.

If a farmer gives the public access to his land based on an entry fee paid then the land is private but the space is public since the public now has access to it.

 

Do you really want to argue if you should  or should not wear a mask on the TBMTBC trails?

If you want to argue weather you can access the TBMTBC trail without a mask, then you should read the TBMTBC notice wrt to the trails.

Do you really want to argue if you should or should not wear a mask on the TBMTBC trails?

If you want to argue weather you can access the TBMTBC trail without a mask, then you should read the TBMTBC notice wrt to the trails.

I was never arguing about the mask, I was arguing over the statement that private land is in fact public.

 

The trail rules also dictate the wearing of masks as a condition of access, even though that is law set out by the government it is also been included as part of trail access rules. They are free to choose as to weather or not to enforce that as the land is private and not public.

Let me just say this, you dont wear a mask and get arrested and get the Virus in the van= DONT cry here.

 

 

Hows getting the virus in the van related to mask wearing?? Its not airborne. You;ll get it from the police officer breathing into your face because they're not wearing a mask so you having a mask isn't going to help you.

And lets face it, you'll get arrested for farting in public these days

You are correct, not related directly.

But the police has touched the van and you touch it and and and....and yes you get it from police also shouting at you while arresting you.

 

And again you are correct about the last also. 

 

TBMTBC trails access can easily be lost if people do not adhere to the rules is what my main point is.

Public space is defined as public land.

Private land is defined as land with a title deed belonging to a private individual or entity other than a government department.

Private land can have rights of admission clauses that includes mandatory wearing of mask's but it can also say "phuqit don't worry about the mask as long as you social distance."

Government land, roads, parks, pavements etc well then everything applies and can be enforced by an officer of the law. On Private land the land owner has to give permission to the officer of the law to enforce the regulation or they can chose to enforce it themselves.

Unless the DA gets its byLaws ratified in the western cape then the law has the right to enter your private property without a warranty which seems to be a concept you're advocating....? Clarify please.

Well as explain above this depends on whether TBMTBCLUB and the landowners want to have that regulation enforced or not. Private land is not a public space so they don't have to enforce wearing of masks. Peroanlly I think its completely unnecessary and will likely cause more accidents than prevent the spread of SARS-COV-2
