If they had not designed it this way, everyone would be complaining that they can only use an expensive S-Works crank on their bikes.

 

Oh here's an idea, why not design a bike where you dont have to use an expensive-brand-specific crank that leaves everybody crying over stukkende bb's?

I've just booked my wheelbarrow in for a service at Cycles Direct...hope it comes out OK!

As I posted earlier, they are probably going to go the legal route stating on the slip you sign away all recourse against the store and they will stick to the law and not go out on a limb. 

 

Interesting, I came back to this thread now as on one of my ride groups cycle direct and the BB was mentioned regarding this thread. News spreads very fast.

Having said all of this, Cyclesdirect have offered to repair the frame. Bogus has legend status here, so if anyone can do it, he can.

 

Personally, I would not want a repaired frame, but legally you will have a tough time fighting this.

 

They broke your frame, they are taking action to repair their damage by using a reputable carbon repairer. I doubt a judge would rule in your favour.

So wait.... is Cycles Direct your "previous" LBS? You have moved away and is now at another LBS? Is this new LBS the one that suggests it should be epoxied cause they unearthed the problem?  :eek:

 

Cycles Direct is then trying to now solve your problem for you even though you are not here anymore?

Ek het en is confused so wil net weet wie is wie hier. Want die "nuwe" LBS klink maar dodgy as hulle se jy moet die BB epoxy

as good as Bogus is... is he an "authorized" repair centre for Spez? probably not

well, the fact they initially offered a replacement frame suggests the frame manufacturer is not ok with the repair option. The LBS needs to prove the 'repair' will restore the frame to design/ structural specifications.

Will Bogus vouch for the 'repair' on that level?  I'm curious to hear this.

I appreciate the cause of failure was due to the negligence of the LBS when they installed it. But I suppose one could look at it from another point.

 

TREK replaced my frame under warranty - however i had to sort out & cover the costs on issues that were not transferable like boost rear hub, rebuild, re cable & run longer Hyd brake hoses as the new frame was internal routing.

 

This is why a lot of companies have, or should have, a consequential damage clause in the terms & conditions. So they will warranty a claim for damages as a result of their workmanship, but are not liable for any damages as a consequence of the failure.

 

So in your case they were prepared to rectify you direct damages as a result of crappy workmanship but not the consequential damage you sustained in terms of rebuilds etc etc

 

Many years back our company supplied steel certified pipe to a large chemical company which failed causing their entire plant to shut down for 2 weeks. The company claimed new pipe and lost production costs amounting to millions of ronds.

 

We replaced the pipe and declined the production costs, they took us to court and lost due to our consequential damage exclusion clause in our terms and conditions of sale which they accepted when they signed the credit app with our company.

 

Personally i would have taken the new frame and funded the re-build myself. But i would have insisted they replace the boost crank if that was damaged as well

It looks like they are gambling that you won't take legal action. That's going to come back to bite them. 

 

I don't know what a replacement frame costs but small claims court is free up to R20k...
