Issuing lawyer letters doesn't make you less of a liar and a thief

I am reminded of the Emma Sadleir letters issued when anyone mentioned Kevin Evans in the same sentence as doping.

I feel this will end in the same manner. TB will be guilty of lying, thieving, stealing and being a POS just like Kev Ev was found guilty of being a doping liar POS

Some stuff may be redacted but the truth will come out eventually

27] Section 235 of the TAA criminalises tax evasion. The section provides as follows:

235.   Evasion of tax and obtaining undue refunds by fraud or theft

(1) A person who with intent to evade or to assist another person to evade tax or to obtain an undue refund under a tax Act—

(a) makes or causes or allows to be made any false statement or entry in a return or other document, or signs a statement, return or other document so submitted without reasonable grounds for believing the same to be true;

(b) gives a false answer, whether orally or in writing, to a request for information made under this Act;

(c) prepares, maintains or authorises the preparation or maintenance of false books of account or other records or falsifies or authorises the falsification of books of account or other records;

(d) makes use of, or authorises the use of, fraud or contrivance; or

(e) makes any false statement for the purposes of obtaining any refund of or exemption from tax, is guilty of an offence and, upon conviction, is subject to a fine or to imprisonment for a period not exceeding five years.

(2) Any person who makes a statement in the manner referred to in subsection (1) may, unless the person proves that there is a reasonable possibility that he or she was ignorant of the falsity of the statement and that the ignorance was not due to negligence on his or her part, be regarded as being aware of the falsity of the statement.

(3) Only a senior SARS official may lay a complaint with the South African Police Service or the National Prosecuting Authority regarding an offence under this section.”

Are you sure it is not TB himself that created that group on FB?

If anyone does get a letter I would scan that thing for AI use and research the lawyer who’s offices its claimed to have come from.. situations like this you can’t take anything on face value unfortunately

Years ago when I started in business, my partner in a venture always said "never use small fry attorneys, they're not worth it".   And ever since I've used ENS.   They've been incredible on everything and literally perfect.  Whether it's dealing with shitty suppliers or negotiating contracts.     I said to the one attorney on a recent issue where a supplier tried ripping us off and overcharging and then threatening us with being sued, that they dealt with it in minutes.   His reply was "we're the pitbulls on crack cocaine lawyers". haha.

So Tauny boy, bring it on.  DM me for my full name and ID number.   I'll see it through.  Challenge accepted.    Also as someone who's literally gone to court for defamation (and I won), I'll confirm he (Taun) doesn't stand a chance as he cannot prove the VERY first thing he's going to need to:   his reputation.  And the other part of defining his loss financially - he will need to show all his scam numbers and how his scams were impacted, but you cannot claim that as a loss.   So bring it on cu.nt.

So he first thing is he needs to prove his reputation by calling character witnesses or creating character affidavits.? I’ve never really dealt with defamation(yet😳🤣

but financial fraud I’m dealing with personally right now..

agreed, but also not really.. the first consult I did with a big firm in Morningside and the founding partner wasn’t interested and his advisement was ludicrous.. (we talking fraud in the tens of millions😳)

Yes, the very foundation of a defamation case the person claiming to be defamed has to first prove their reputation, and only after that they need to then PROVE how you damaged it.   And then put a quantifiable amount in Rands on it and then prove that.    It's actually one of the most difficult court things to win from what I can gather, going through it myself (ironically against a big cycle distributor, so related to this forum in some way! LOL).

The thing with the big firms is that they're not like the backyard attorneys who will "give it a try!", they are upfront and outright if you're pretty much not going to win or gain from it, they tell you and kill the process.  It's been a life (and wallet) saver sometimes when my head wasn't so cool against inferior suppliers, which are a huge problem in my industry.

But I also dont think Tuan has a real attorney worth his salt for ONE reason:    if someone says "fnck you, I'm happy to be sued for defamation, bring it on" (like me) the challenge for him begins:  he firstly actually has have this served on someone and get a court date, then pay the attorneys costs, but even if he gets this far, then is he going to perjure himself in court with fake documents?  who is going to come and back him up under oath without concern for their own perjury considerations?   is he willing to have all the dirty laundry of his deeds become public record?  and lastly when he loses (almost a slam dunk guarantee), he opens himself up to costs (not that he'll pay, but there are ways) and the fact that he cannot threaten the smaller fry with his tactic again.      I dont think he's big pictured this or gotten VERY bad legal advice on this avenue.  It's worked so far, but all we all need to do is accept his challenge, group it all together as respondents, and see it through to court.   I'm pretty sure he'll back out before then, but if he doesn't,   it's going to be a jol and a half.
