Yes we can.

That thing was erected right over the walkway, a path used by runners, pedestrians as well as cyclists.

Secondly, the JMPD of Midrand don't allow any signs to be constructed on pavements .

And that pavement is much wider than what you can see from the images.

 

The official paved walkway or the dirt path next to the holes?

 

If it was right across the paved walkway, then I would say you have a good case legally, if it was across the dirt path (probably from people taking a short cut) you will have a tough time.

 

Eitherway, they should have had some kind of a warning in place, maybe red tape etc.

In Midrand we have exceptionally wide pavements, one of the reasons is to try and keep the idea of "Country Living" alive.

A bit further back, that footpath you see, becomes three footpaths, with no paving next to it, the only reason you see paving on that section is because it's a corner, the rest gets used by everyone who lives in the area.

This could have happened to anyone and as I pointed out, cyclists, runners or even people walking their dog.

It's an illegal construction, and if you see how the JPMPD take signs down in this area, you would understand.

The crossbar was not visible at all.

If a normal person was walking he would have also got injured.

I have highlighted the ends of the cross bar for you in the picture.

There is absolutely no way you will see it.

 

The scary thing is it could have happened to anyone of us that was there.

The photos clearly show the poles were errected off the road and off the designated pavement/walkway. How are they to know that someone would be cycling there.

 

It looks as if they were going to errect some sort of sign.

Why put it right there though? All that grass area to aim for and they plonk it right across the one part that is clearly used as a footpath. It makes no sense and at best a bit shortsighted if not just bloody stupid.

Hope the rider makes a full and rapid recovery.

That looks like summerset estate in Midrand? Try see if you can get hold of the CCTV footage from the gate, there is a chance that a camera has a view of the site. The estate is quite jacked up from a security perspective, go to the gate and try get hold of the estate manager.

if Joburg metro or provincial DOT have no record of an application for that sign then it is illegal. If it were legal then if the contractor who put it up is ISO rated then they will be liable for damages as they had no visible warning of a construction in progress, else the municipality will be liable...if it is illegal, then you need to go the legal route with the responsible party

is that along Garden road? I'll see if any of the early shift guys at work noticed anything untoward, but there's lots of security guards buzzing around on their quad bikes usually - maybe have a word with them.

Can't make out from the pics how the poles were planted, looks like 2 holes dug either side of the dirt path held up the green poles and the crossmember was wired onto those?

But carpets pic with the highlighting circles 2 steel pipes that look like they are planted into the ground?

 

Hope the poor guy heals soon, nothing worse than those out of the blue slams, even more so when some twit put something in the pathway that caused the accident. Have had a few close ones with wire strung over random areas to hold up poles and other objects.

Hi Running man.

Yes that image is very outdated.

I have just come back from the ICU where Ben is.

He is jovial and even busy on his phone following the Epic.

The doctors did a great job and the operation went well.

They have put a plate in the eye socket.

completely bizarre but all the best for a speedy recovery Ben.

Was trying to make out what the poles were about, this is whats on Google street view - the imagery may be outdated but it may give some idea.

Would that sign then be illegal, along with all the estate agent boards?

The picture was taken ages ago.

Yes the estate agents signs also gets removed by the Midrand Policy and JMPD.

Those estate agents should be charged & fined for wasting Police time if that is the case, as well as the people that put these illegal signage up.
