Ja but could be collusion. Shop may have been asked to invoice ABC knowing it was a replica (not a fake) so that it could be insured for full value etc. then something went wrooooonnnnngg

 

The first items of documentation I ask for when underwriting a new risk are:

  • Invoice
  • Photos
  • Valuation
  • Serial numbers (where applicable)

Without those I don't accept it. Even greater detail is requested in the event of a claim against the policy. The OP doesn't strike me as "dodge", he has played open cards from Post #1. I can't say the same for the LBS however.

I see there is a Fong Kong dogma in the classifieds....not sure the best tome to sell one now, hats off for being honest about it though...

Not sure about that one.

 

There seem to be quite a few different frame types. ie. Different routing caps, positions and angles as well as Di2/EPS mounts either under the downtube or under the rear non-drive side chain stay.

Don`t insurance companies ask for frame numbers anymore?

The only thing that hmm miss me is if I were in that position my recourse would be.

1. Contact supplier.

2. If no joy contact my legal.

3. Then contact social media.

 

This seems to have been done wrong way round.

 

I done know either party, but from what I see here everything is dodgy. But that is just me.

 

The money as stake here is huge in my book and there is just too much ........ at the moment. Will like to see what the courts say. I believe both are going to such on the hind tit from reading between the lines.

Hypothetical situation

You fly down to Oz for work and take your bike with for a bit of a trekking holiday afterwards.

For the last leg from Dubai you sit next to a very Groot Oom. So that by the time you’re moving thru Crocodile Dundee International: Arrivals you look like a person that may have swallowed a few bags of white powder. So Customs pulls you to the side and start going thru your luggage.

They open up your bike bag and on inspection inform you that unaware to you, the bike is counterfeit. In precisely how much trouble are you?

Will the item be confiscated?

Will you be charge for attempting to bring counterfeit goods into Oz?

Will it affect your working permit?

Will they throw you into a holding cell and put you on the next plane out?

Point 8 seems to contradict points 6 and 7 ? :blink:

 

Just be clear, is the item a fake or not? So by extension, the assertion by ASG, the bike shop and Pinarello is also false?

 

All the poor legalese is starting to remind me of Nkandla.

hi ,i have a 65.1 dogma that i imported and i now that mine is a oem model , im riding it for 15 mounths now and i am very happy with it . But i now what i have paid for it , i can not complain. Today MOST top end bikes are made in the east asia . when they get sent to italy (EG). IF THERE are cosmetics problems on theme it becames a (oem model). i fill we get taken for a ride by all the importers in SA . mine is eng thread. my does not have the made in italy on yhe down tube. yes no serial number under bb. I fell for you ,if you were charged an arm and a leg.

 

This perception that the OEM manufacturers will sell exactly the same product to the market as they are manufacturing for a brand is nonsense. Why put their relationship with their big customers at risk by selling their products to others. Whilst far from an expert about this, I have visited China three times looking at oem's for equipment that I buy and, of maybe a dozen factories visited, not a single one will sell the same stuff under a different brand name.
