if you knew about the defect but did not tell him then legally he has a claim.

 

If you did not, politely decline.

 

Voetstoets is not a blanket absolution when selling anything, there is much misunderstanding as to what voetstoets really is.

I swear that I sold these wheels in good faith.....They were fine at point of sale...I did not "replace" anything with something cheaper......I have a good few 100% ratings on the hub...Surely this should count for something.....

no, i paid full price R1400.

 

I could not sell them like this.

 

i have not checked if the profile is identical. i will tonight

 

i am not calling it a warranty. This is a dud and there is no time restriction on misrepresentation.

But it came down to He said She Said and it will go on forever. Just move on. Its the best way forward...

Otherwise this will eat at you and make you very negative...

Friend of mine owns a few brokers.

 

They caught a guy, who tried to claim a new frame on his warranty, supplier declined.

So he proceeded to drive over his bike with his bakkie, and tried to claim from his insurance saying he "fell".

I've heard of a few brokers who've actually advised their clients to carry out actions similar to this, just to get a claim paid...

For it to be misrepresentation don't you have to prove that he was aware of the fact that it was damaged at time of sale?

 

If he sold it with no intention of defrauding you, and you were both unaware of the issue until now, I don't really see how you can warrant asking for your money back. . .

the rims were neat , clean and straight. spun freely . that is what i checked before handing over money.

Since the original picture, the rim was replaced and  stickers swapped.

 

Lets do the maths as you cannot swap stickers:

R600 Sticker Set

R300 Cheap New Rim

R450 Wheel Rebuild

That is more than you paid for the item. It makes no sense to me to go through all that effort to mess with someone....

Just one point - not everybody does all (or most) of their braking with the front brakes.  I've got many customers who will wear through the rears far quicker than the front.  Some even go through multiple discs and pads at the rear while still on the same set of front pads.  

So saying that the front is not worn and therefore the rim is new is simply false.  It's all about riding style and rider habits.

Has a bike shop had a look at the rims. 

 

Take them to a reputable bike shop and let them give you a quick report. They will tell you:

a) If it is in fact a "stress fracture"

b) If the front wheel is a hong tong special.

 

Next question, as you did not inspect the wheels on the day, how do you go about proving that the fracture did not happen while in the box at your place?

 

There have been threads before about wheels fracturing the hub/rim in storage.

I find it hard to believe that anybody would buy something ( especially when they going to build a bike and by the sounds of it build it yourself ) and not ONCE look at the new purchase in 6 months, not once !

 

Generally speaking when someone builds a bike rather than buying a whole bike is an enthusiast and would peruse,rub & feel every purchase as he goes. And ogle over his parts.

Nah. Bruh, your story is wank. He'd have paid more for the rim and relacing than he got for the entire set.

You laugh, but the driving over the bike/front wheel is rather popular. You and your Mrs finish the race, you put bikes in back of car, hand wife wheels, she is chatting to friends and you reverse over two removable speed bumps :0

 

Or people just get home and realise they did not pack the front wheel in the car and left it against a tree  :clap:

Agree with you dude. Absolute bulls**t unless the oke never rides faster than 5kph. Rear wheels have no real stopping power, lock up easily, skip and flat spot!

I brake mostly with front brakes on my mountain bike, roadie gets most of its braking done with the rear.

Never had a wheel lock up, skip or flat spot.

Road braking is far more predictable and lighter than on a mountain bike.

Surely appreciate your concerns and understand the Seller's denial of any withholding.

 

The only recourse you have is to rate him according your trader experience using the BikeHub rating system.

But do you have any evidence of your wild accusation? Also do you have any evidence that you did not use these wheels for 6 months?
