Not paying a cost order, grounds for contempt of court?

I have a meeting with my lawyer tomorrow afternoon.. I’ll ask😉

it’s not far off what the meetings actually about anyways..😰
I would imagine so though.. court tells you to do something there are surely harsh consequences if you don’t do it.. otherwise what’s the point of it🤷🏼‍♂️

We hubbers have been reading and commenting on the woodfetcher for years without anything happening to him.

We now have a lady that is spending a lot of energy on getting justice but she needs help .

Is there not a practicing attorney in the Cape Town area that can assist her Pro Bono ?
I am happy to contribute to some legal fees if necessary.

Would have done it myself had I still been a practicing attorney in CT

If the case is closed, it will depend on the judgment rulings whether it can return to court or if it is gone for good was it dismissed without prejudice? I don't think a private attorney could do much since this is a state prosecutor's case. This individual appears to be highly educated and well-versed in the law, using his expertise to register entities and create formal contracts that force individuals into civil action rather than criminal. He also takes amounts that render court cases unviable for victims. I believe that any civil action taken would likely yield no rewards, as you cannot extract blood from a stone.

My plea is that an attorney with criminal law expertise will assist her and others to elevate the investigation and prosecution . I agree that any civil action would be a waste of money

A private attorney would require a "nolle prosequi" certificate from the NPA, which highlights the incompetence of the state, making it challenging for them. However, the way the case was closed would determine any further actions.

Hi Taun. I know for a fact you are reading this.

Pick your next move very carefully. The whole of Bikehub and 4x4Community is standing behind Belinda Roxburg and we have her back.

An attack on her is an attack on this community.

I suggest you step away, reimburse her what she is due and reconsider your ways.

Easy to sit and assume that lawyers can take pro bono work like this.. it’s not that simple.. matters that end up in court cost thousands a day.. junior advocates can be 10k a day.. it’s a lot for someone to just take on pro bono..

If anybody knows this it is Arno so he is asking for the ball to roll and have the shyster sit in jail.

I think we all feel the same hence people offering to make contributions..  Maybe the 4x4 club could be involved

And by the way, Arno does not "assume"......he knows.

Deep brown, I don’t know who Arno is, nor what he might assume.. “sit and assume” was an indirect phrase.. it didn’t need to be pointed at anyone in specific 😉👍🏻

Maybe I should have written in Afrikaans my mother tongue so that some readers would have understood what I was trying to say and not put their own interpretation forward.

Okay so not “contempt of court”, but you will end up back in court and spending more money chasing your money.. 🤷🏼‍♂️ court is a rich man’s game.. 👍🏻

Hey Arno,
I have no doubt about your abilities as an attorney. How important is the ruling that was handed down, and does anyone have a copy? Surely any advocate worth their weight, when faced with a case being thrown out or dismissed, will try to ensure that it can never be placed on the roll again. I'm sure this was a priority for you as an attorney. If "without prejudice" was granted, then is the case done for good? Can nolle prosequi be requested if the case was already before a judge and was dismissed?
