Few hours later "case thrown out" (sorry for the laymans terms) ... must be tried as civil rather than criminal .... last few pages are trying to figure out WHY ....

I am still following up on what actually went down at the court. Have not yet managed to ascertain the name of the prosecutor that looked at the case however should have that soon. My sense is they took one look at the wad of paperwork and the list of people owed money by Taun and came to the incorrect conclusion that it is all about money owed when in fact it is about fraud which is absolutely a Criminal case. Unfortunately my detective is drowning in paperwork and case overload so needs a bit of encouragement, however this is not over yet🤟

Money owed would definitely be a civil matter.  But the minute he used fake POPs as alluded to above, that's criminal?

The article about his arrest was shared on a Somerset West community FB page, It was then shared by 1 of the members to the second hand cycling sales group on FB. I commented saying wont be surprised if the poster gets a inbox threatening with legal action if the post isn't removed bla bla, and checked today, post is missing so has been deleted.

 

He really must have people looking out for him letting him know whenever there is a post about him on any platforms because posts are quickly removed.

How do friends and family keep who keep a eye out on his behalf and warn him when people post about him, manage to sleep at night? They then know what he is up to and are assisting him.

If he was a family member or friend of mine and I knew about his shenanigans, I would cut all ties with him.

Until he is found guilty of any the accusations and charges, anything said about him is probably seen as 'crimen injuria', which he feels that he can act on.

He has previously sent 'Final Letters of Demand' to remove content referring to him and filed 'Notice of Motion' for 'Personal Damages' and 'Loss of Earnings' against BikeHub and specific Hub Members.
Matt took that further, and won in court. But it took time, effort and money.
I don't know how the other individuals reacted.

I imagine that he has done that to all other forums too. So, he must spend a lot of time doing this in reaction to all the 'bad press' against him which is mounting all the time.

Until the accusations are proven anything negative can be seen as defamatory.. to which he has legal recourse unfortunately.. definitely weaponizing that angle of defense to keep operating..

These types of okes will make anything look like something else.. as long as you look bad, they don’t care.. strong offensive defense.. 

they play the victim and make it look like you are harassing them etc.. 

best to not give them any ammo.. I’m not the best at that though 😳🤣🤣

You should let him send you a notice or a legal court order. Then you see him answer in court, in person.

His letters are just bully tactics from a grade 4 school yard. Best way to deal with the bully is to take him head on

Yes, that's correct. And borrowing bicycles and not returning them is also criminal. I have also been advised by lawyer that anything posted on social media is not defamatory as long as it is fact.

Facts are facts.    

Defamatory / opinion / etc I agree, do not post.  But facts?  Truth?  100% share away.

Borrowing and not returning is called theft.  As long as the original owner asked for it back.   Was a case of theft opened against him for this?
