For it to be misrepresentation don't you have to prove that he was aware of the fact that it was damaged at time of sale?

 

If he sold it with no intention of defrauding you, and you were both unaware of the issue until now, I don't really see how you can warrant asking for your money back. . .

i see this quite simply.

He had the wheels in original spec.

took photo.

replaced rim with lower spec whatever was available.

transferred stickers. poorly.

I swear that I sold these wheels in good faith.....They were fine at point of sale...I did not "replace" anything with something cheaper......I have a good few 100% ratings on the hub...Surely this should count for something.....

I absolutely believe you 110%. My reposnse was more aimed at the multitude that seem to think selling something voetstoets means there are no repuercussions.

 

Selling something as voetstoets still has legal requirements and one of them is full disclosure

You have absolutely zero proof of this dude...Unfortunately.

If you did then different story.

As it is...you're like a pirate...or an Oscar...no leg to stand on.

the rims were neat , clean and straight. spun freely . that is what i checked before handing over money.

Since the original picture, the rim was replaced and  stickers swapped.

 

how can you prove this ??

You laugh, but the driving over the bike/front wheel is rather popular. You and your Mrs finish the race, you put bikes in back of car, hand wife wheels, she is chatting to friends and you reverse over two removable speed bumps :0

 

Or people just get home and realise they did not pack the front wheel in the car and left it against a tree  :clap:

 

We replace a ridiculous amount of wheels (mostly from kids bikes, but quite a few regular bikes too) that have been driven over when left outside, behind the car, etc

Why not take the wheel to a reputable bike shop and that would clear this up .

 

Because the buyer could have easily done what he claims the seller did.

There's simply no proof the wheel the buyer is presenting is the wheel he purchased.

That seems like a lot of effort for R 1400. . .

In that case you are very unlucky and paid R1400 school fees for taking 6 months to check this as you could have done the above in the past 6 months.
