Cycling Kids driven off the road - Cape Point

Unfortunately the legal system failed these kids.
By being the first one to get to SAPS you can deny bumping cyclists off the bikes or driving over the bikes. The investigating Officer will believe you and not your victims.
Getting into cycling to get away from drugs, gangs and other unholy influences taught them a tough lesson :

 - the truth does not matter,

 - SAPS investigation officers prescribe to the charge office what cases to accept and what not

 - SAPS is not my friend

- the one who gets to SAPS first wins

 - everybody is not equal in the eyes of the law

 

If ever you are involved in an incident in the Deep South check the registration against this picture

Not legal advice, just based on previous experience.

In the context you’ve posted. Lay the charge, it’s criminal assault at the least. You have witnesses etc 
SAPS cannot deny you the right to open a case on the basis they explained, ask for the station commander to see/open a case with IPID against any officer stating this.

Document everything! Including video.

If you’re going to commit. Get a legal representative with experience in this area, asap. PPA may be a good start.

Don’t drag on this and waste time on forums/socials. That can come after and with the security of legal backing, one wrong post can ruin/undermine your efforts.

Keep the faith please .Many years ago I was assaulted and laid a charge of Assault GBH.

My Assailant got creative and laid a very creative countercharge that placed a lot of stress and pressure onme personally. Despite being completely made up the SAPS took the accusation and laid the charge on his behalf.

After a long investigation his charge against m was thrown out due to lack of evidence and my charge against him stuck, He was convicted and let off with a suspended sentence and a warning, but he struggled to find work thereafter. Apparently he didn't learn his lesson....

So despite SAPS incompetence the truth prevailed. Not every outcome is this positive but you have the weight of evidence in your favour

Excellent advice.

I see thise kids often. Gave one of them a choob a while back. I remember thinking he looked terrified of me. 

Hope the ppa can do something here. Please let us know

Thanks for this. At least we know who to look out for. Has the driver (who allegedly threatened to kill cyclists) been identified?

Monday, 13 April, I experienced something that shows just how dangerous that negative anti cyclist mindset has become.
Everyone in the Deep South knows the kids from the Fresh Start Cycling Club — riding in their Rawson Properties kit.
Late yesterday afternoon, I came across them at Klaasjagtersbos Gate on Plateau Road, just outside Cape Point.
A Citi Golf travelling towards Red Hill knocked some of the riders off their bikes. No serious injuries.
The driver stopped and reversed back to the grou but instead of helping, he told them:
“Next time I will kill all of you f***ing cyclists.”
He then drove off — running over one of the kids’ bicycles in the process. Keep in mind that he just seconds earlier reversed and leaves in the direction he reversed from.
Let that sink in.
This could have ended very differently. They were millimetres away from another tragedy.
What makes this even harder:
•    The rider whose bike was destroyed is a promising young cyclist — he podiumed at Killarney just this past weekend
•    These kids come from communities facing gangsterism and drug abuse — yet they choose discipline, sport, and a better path
•    They ride hand-me-down bikes — not expensive gear
•    That bike wasn’t just transport — it was opportunity, purpose, and hope
And in a deliberate act of violence, it was taken away.

To me it is important that the legal system kick in and that this guy is prosecuted and that the legal wheels start turning against wreckless behavious towards cyclist.

No for the real problem:

When he drove over the bike a kid picked up a stone and throw it at the car. The driver laid charges of malicious damage to property at SAPS in Simons Town. He claims the stone broke the rear window (but a picture we have shows no broken window). When the club went to SAPS to lay charges, they were informed that the driver already opened a case and SAPS refused to accept charges of reckless driving, etc against the driver.

The driver is prepared to let the charges drop against the minor child (he is in primary school) if they pay the R1900 towards the broken glass. No repercussion for him.

I insisted that they go back to SAPS - we are going there this afternoon to try again

Are there any legal eagles on this group with a passion for cycling who is prepared to advise the club?

My blood is boiling as well. This is totally unacceptable. They shoud NOT pay the R1,900 and must - I hope they already have - lay a counter charge. 

How about an organised solidarity ride en masse to the policice station? The Office of Premier Winde ashould alos be made aware of this!

Interestingly though, I did find out that even an off duty member of the armed forces has a duty of care towards civilians. Which my understanding means that even if he was driving a personal vehicle the military police can charge him. Good luck with that...unless you've got a contact it's another dead-end...or at least it was for me ☹️

That is possible, hopefully not. There are lLots of bad reports about the conduct of navy people on local roads!

What has this car done? It seems to be maintaining a safe distance from the cyclist. Is that the one involved with the kids?

I would also like more definitive evidence.  But if it IS the alleged vehicle in question at least we have a reg plate should the driver cause further injury or death to cyclists

Only saw this now. How about laying the charges at ocean view SAPS? It's most likely where the kids are. It's more than one kid assaulted here so nothing stopping multiple complaints by parents. 

 

Also, I'm in the area so have seen the groups often. Were any of the adult riders on the scene, if so did the driver go for the adult too or just vloek at the kids? I'm guessing you got there after it had happened.
