I DONT KNOW looking at there letter i seem to think mr armstrong, can afford a "different level" of assistance

 

A family member once receive a couple of threatening legal letters from a 'cheap' attorney. We then enlisted the services of a highly-rated attorney from a large law firm. It cost an arm and a leg, but only one legal letter from our attorney was required to settle the whole matter in our favour!

In the case of bringing in a bicycle as sporting goods, you declare you are the owner and its for your personal use and if the value is under R25000, and you paid VAT or other tax on the other side without reclaiming it SARS will no penalise you.

 

So yeah thanks for the offer but having imported many things for business and personal needs I have a fairly good idea of what attracts tariffs and what doesn't.

 

I filled out a similar form to theITAC form you presented when I repatriated in 2004. This was for declaration of my container with my household contents. Yes duty was applicable to this according to the value on the mainfest and the bicycles did not attract duty. Furniture, appliances, eletronic items did.

Chris, the OP never mentioned the fact that the bike was sprayed, only after it was disclosed in the "legal" response from the other side did he come clean and said he asked for black on black.

 

Still doesn't really answer your question really.

 

All we know now is that the frame was sprayed, and therefore obviously not on display in full DOGMA guise....

what was strange to me is why is it not on the invoice, its expensive to pay for a spray, but then no water bottle holders :eek: ITS ONE THING ASKING FOR A SPECIFIC COLOR ITS ANOTHER ASKING THEM TO SPRAY A BIKE, to me this shows more guilt on there part because the margins allowed for a respray without charging the customer

Haven't read all the pages, but in summary:

 

A bike shop with a physical location sold a fake/counterfeit bike claiming it was original at the time of taking ownership, then conveniently saying the OP knew it was a grey import (despite invoice stating DOGMA 65.1), in the process ripping off an innocent customer.

 

Customer voices that he is unhappy with bike shop fake bike (after being alerted to this by an LBS Down Under), and instead of bike shop trying to sort issue as quickly as possible, gets "someone" to post their lawyers response (which makes me feel they know they are guilty as...)

 

Feel sorry for this chap, cr*ppy situation... Hope you sort them out properly!

As an aside, the response from the shop ain't a lawyer's letter. The first, and maybe one or two of the other points are usual legal threats - I get them all the time - that lawyers try to bully people with you. The rest is from the bike shop itself, I reckon.

Maybe the OP didn't ask for a REAL - DOGMA?

 

Maybe he expected a fire pool, and only later realized he was duped when he came back from overseas and he saw he actually got a swimming pool.

not to be funny, but I'd like to see a pic of the fake DT wheels, for interest sake, as well as the genuine Aussie grey import Pina.......they still are pretty hot bikes.......

 

A bike you buy for yourself from a valid, authorised retailer and bring back to SA with you is NOT a so-called "grey import".

If you'd read beyond 10 pages you would have seen this reply from the OP.

 

I didn't ask for the bike to sprayed i requested the 'black on black' colour i hope that clears it up.

This is my take on the situation and I could be wrong?

 

Ok so the OP orders the bike on the 21 November 2013?

Cycle Science then place the order with there Grey Pinarello suppliers (Factory in China)? This could be why he only got it on the beginning December 2013?

 

As for the 5 year warranty on components, surly a groupset falls under this? and Campagnolo only offer a 3 year warranty on electronic groupsets. So is the shop going to cover the extra 2 years? or buty components that mean all the imported fakes?

 

On the costing "R 37 500-00 for the bicycle (consisting of a frame (at your insistence sprayed a particular shade of black), head set, handle bars, wheels and saddle column)" Ok I get this.

 

Now lets do some maths R91 000.00 - R37 500.00 = R53 500.00 for "The balance of the amount paid by you was for the purchase of a Campagnolo Record (Electronic) group set (consisting of the pedal’s, crank’s, bottom bracket, bearings, front and rear derailers, chain, gear cluster, cables, chain blades and brake mechanisms), a Sella Italia saddle, tyres and tubes for the bicycle and certain related miscellaneous items."

 

Now this is where things don't add up. Campagnolo Record EPS Groupset R40 000.00 I see Pedals are included with the Groupset so i'm guessing they are Time Pedals? Sella Italia Saddle? This is apparently also fake, so for augments sake lets go with the real thing, lets say top of the range SLR Carbon R3 800.00 Tyres and Tubes? R1 500.00 should cover it. Now add that up and you get? R45 300.00 now R53 500.00 - R45 300.00 = R8 200.00 for miscellaneous items? and that's with out the fake Saddle which probably costs R 1 000.00. So what the heck did the OP spend R8 200.00 on or did he get taken on a ride for parts as well?
