This Pr#ck jumped the stop street. I collide with said Pr#ck. His insurer says I am 40 % guilty for " not being more observant " . Will only pay 60 % of my loss based on current values. Car total loss. Sitting with a piece of irreparable scrap and some pocket money. I am just letting off some steam with this post.

This doesn't sound right. If he jumped the stop street, he is guilty. It is not your responsibility to make sure that someone obeys the laws of the road! There is no "partial blame" in an accident. Are you insured? If so, claim from your insurance and let them sort it out. If not, I suggest you get some legal advice.

they play this dirty trick on every body. I waiting to hear about a case where your car was parked and they throw the same line.

 

I think it is bullsh1t. Surely this can be tested in court. But alas, we don't all have extra money for legal fees

While insurance companies are a pain in the ass. This is kind of how it works. Always always have you're own insurance on a car, not worth the risk.

Challenge them. They always try bully tactics as a first response to pay less. Tell them you plan to go to the ombudsman, and then follow through if they don't budge.

 

Also, did the pr#ck ever admit to being at fault?

This.

Its pretty much their first action. If you have your own insurance go to them to fight it, if not go to the ombud.

Go through your insurer - they we sort it and claim from his. It is common practice known as knock for knock - or call the ombudsman as some have said. Good luck

I got them to adjust the values to a more acceptable base ( still not fair values ). They will not budge on the apportionment. Saw lawyers this morning. They will take it up , but their specialist say "apportionment " is the accepted norm.

It may be the norm but sometimes one party is 100% at fault.

I was insured with Outsurance ( 3rd Party , fire , theft, never-ever ) Decided to not " use-up " no-claim bonus and handle the claim as Mr. Pr#ck admitted guilt in front of witnesses . WRONG DECISION. It is the insurance company of Mr.Pri#ck ( CIB , somehow linked to ABSA )that is making the offer in full and final settlement
