Shocking Checkers SA

It most definitely does.

People need to understand this:

Ideas = cannot copyright this. the jelly bean on a sock is an idea.

Designs = can copyright this. if the designs look similar enough (colours, shape, size, whatever), someone can pursue the case.

Is that not more of trademark question then?

Good grief.

Do people really believe that some honcho at Checkers said to himself, 'Mmmmm, those Versus jelly bean socks are selling like hot cakes, let me quickly order some knockoffs so that we can sell them for cheaper and make a fortune.'

I have firsthand experience of the buyers at big retail chains, believe me they are risk averse like you wouldn't believe. If there's the slightest chance of something not being legit, they run a mile.

We really need to get over this 'big business is bad' thing, it's complete horse manure.

There is no big business.

There's just people in all their glorious imperfection.

I laugh everyday when people say that.

Vodacom "steals my data", Specialised tries to rip us off, "Insurers try to pay as few claims as possible".....

Good question. Answering from my personal knowledge only, but in this case I'd bargain on it infringing on copyright rather than trademark. If the versussocks logo was used, it would be trademark for sure, but the pattern/colours/shape etc of the jellybeans is artistic media only (so not a logo or brand identifier as such) and would probably fall under copyright.

I'm not sure what the fush is over sock design. When there is more inportant things to talk about.

The big question is, how do you let someone know that their hot cakes are selling well?

Most of the big clothing chains send teams to London and Milan each season, they snap pics of whatever looks good, and then fly on to China to brief the manufacturer. The majority of their ranges are nothing more than copies. It's why most high end retailers on Oxford street won't allow photos in their shops these days.

Di you all miss the post of Checkers saying they will discuss with Verses now that the matter had been pointed out to them??

Seems to be easier to keep brandishing the pitchforks for no reason..... would be better to wait to see what the outcome if Checkers discussion!

Well, this is Bikehub after all. Attention to detail and reluctance to NOT brandish farming implements isn't our collective-forte.

First rule of Bikehub: don't talk about Bikehub

What? Sorry, I wasn't listening and my pitchfork rattle drowned you out.

I was going to bring up the Laduma one with Zara.   He's a good friend of mine, has show-cased the collections on a fashion week platform we own, and HAS actually registered the IP of a lot of his designs.   Zara is built on re-packaging designs, and has made the owner one of the world's top wealthiest people.   That said, argyles in this case are argyles.

Versus needed to differentiate themselves and position themselves as a local brand, manufacturing locally (do they? no idea) and showing quality and function over price.  That's how you sell a premium product.

I would rather shiiiit in my lycra than wear socks with jellybeans or bright colours when out riding.  I truly just do not get it.   But that said, for years I've always worn "interesting socks" with similar under my jeans or suit pants.   I had jellybeans easily 10 years ago+ from Topshop, and where I still get many socks with cool and interesting patterns when I travel.

I dont think these cheapy Checkers ones can compete with a proper fitting Versus sock for cycling, but the jellybeans have been around longer than one would think and more likely than not, were simply on display at a trade show and the buyers said "send up 5000 pairs"
