The coffee socks comp left a sour taste in my mouth.

 

The stance socks are much better. Wearing mine right now.

It most definitely does.

People need to understand this:

Ideas = cannot copyright this. the jelly bean on a sock is an idea.

Designs = can copyright this. if the designs look similar enough (colours, shape, size, whatever), someone can pursue the case.

Is that not more of trademark question then?

Do people really believe that some honcho at Checkers said to himself, 'Mmmmm, those Versus jelly bean socks are selling like hot cakes, let me quickly order some knockoffs so that we can sell them for cheaper and make a fortune.'

 

I have firsthand experience of the buyers at big retail chains, believe me they are risk averse like you wouldn't believe. If there's the slightest chance of something not being legit, they run a mile.

 

We really need to get over this 'big business is bad' thing, it's complete horse manure.

 

There is no big business.

 

There's just people in all their glorious imperfection.

Good question. Answering from my personal knowledge only, but in this case I'd bargain on it infringing on copyright rather than trademark. If the versussocks logo was used, it would be trademark for sure, but the pattern/colours/shape etc of the jellybeans is artistic media only (so not a logo or brand identifier as such) and would probably fall under copyright.

The big question is, how do you let someone know that their hot cakes are selling well?

Most of the big clothing chains send teams to London and Milan each season, they snap pics of whatever looks good, and then fly on to China to brief the manufacturer. The majority of their ranges are nothing more than copies. It's why most high end retailers on Oxford street won't allow photos in their shops these days.

Seems to be easier to keep brandishing the pitchforks for no reason..... would be better to wait to see what the outcome if Checkers discussion!
