Yes, the very foundation of a defamation case the person claiming to be defamed has to first prove their reputation, and only after that they need to then PROVE how you damaged it.   And then put a quantifiable amount in Rands on it and then prove that.    It's actually one of the most difficult court things to win from what I can gather, going through it myself (ironically against a big cycle distributor, so related to this forum in some way! LOL).

The thing with the big firms is that they're not like the backyard attorneys who will "give it a try!", they are upfront and outright if you're pretty much not going to win or gain from it, they tell you and kill the process.  It's been a life (and wallet) saver sometimes when my head wasn't so cool against inferior suppliers, which are a huge problem in my industry.

But I also dont think Tuan has a real attorney worth his salt for ONE reason:    if someone says "fnck you, I'm happy to be sued for defamation, bring it on" (like me) the challenge for him begins:  he firstly actually has have this served on someone and get a court date, then pay the attorneys costs, but even if he gets this far, then is he going to perjure himself in court with fake documents?  who is going to come and back him up under oath without concern for their own perjury considerations?   is he willing to have all the dirty laundry of his deeds become public record?  and lastly when he loses (almost a slam dunk guarantee), he opens himself up to costs (not that he'll pay, but there are ways) and the fact that he cannot threaten the smaller fry with his tactic again.      I dont think he's big pictured this or gotten VERY bad legal advice on this avenue.  It's worked so far, but all we all need to do is accept his challenge, group it all together as respondents, and see it through to court.   I'm pretty sure he'll back out before then, but if he doesn't,   it's going to be a jol and a half.

Nice dude.! Yeah that’s great if you have someone solid in your corner..

but no, it was bad advice.. the perpetrator bought dodgey cars that got impounded so tied up his capital in the cars and his scheme unraveled as he couldn’t keep up repayments to his investors with such little working capital.. it all came crumbling down.. started doing fraudulent and basicly became a common car thief.. he lost it all and was living at his moms, I believe the assets are either well hidden or squandered.. from what I’ve heard its the latter.. and the oke still recommended forcing liquidation at a starting cost of R75000 and in his own words “it’s not a garauntee.”

my response was not favorable.. 🤣🤣

I found my lawyer and we just clicked and he’s taken such good care of me.. he’s been practicing law, specializing in litigation since the 70s.. he f&ck old but still extremely capable and vicious..🤘🏻

Years ago when I started in business, my partner in a venture always said "never use small fry attorneys, they're not worth it".   And ever since I've used ENS.   They've been incredible on everything and literally perfect.  Whether it's dealing with shitty suppliers or negotiating contracts.     I said to the one attorney on a recent issue where a supplier tried ripping us off and overcharging and then threatening us with being sued, that they dealt with it in minutes.   His reply was "we're the pitbulls on crack cocaine lawyers". haha.

So Tauny boy, bring it on.  DM me for my full name and ID number.   I'll see it through.  Challenge accepted.    Also as someone who's literally gone to court for defamation (and I won), I'll confirm he (Taun) doesn't stand a chance as he cannot prove the VERY first thing he's going to need to:   his reputation.  And the other part of defining his loss financially - he will need to show all his scam numbers and how his scams were impacted, but you cannot claim that as a loss.   So bring it on cu.nt.

I got an email telling me delete my posts here a few weeks ago, or I'd be added to the pending defamation case. I ignored it, and that's the last I heard. He did however claim to have international backing on his legal costs. I highly doubt that is the case.

INTERNATIONAL BACKING on legal costs?     What a baller!

Phew, now we know where Elon Musk is sending all the savings!  But on a serious note, when people talk like that, you know instantly the bull**** is flying.  Shame, people do fall for this as many actually dont know the law and how it works.

He must send those proper letters instituting legal proceedings, anything else is just dog barking at cars passing by.🤣

Maybe another avenue to explore is to try and get his face plastered in some main line media publications. We all know that some Jounalists are worse than lawyers.

I am sure if enough people that have been at the receiving end of his scams approach a News 24 etc, they may be interested in publishing an article.

Not sure if there are any legal repercussions but will go a long way to spreading the truth of his operations.

I may be mistaken but as far as I know anything legal has to be delivered and signed for. An email doesn't have any fire behind it. Wood or no wood. In order for legality, you have to have evidence the person accepted the proceedings. This is what I learnt by taking someone to the small claims court.

If only his "international backers" assisted him with refunding the people he allegedly defrauded... the wheels of justice turns slowly, but they do turn. His day will come... oh and if lady justice doesn't get you, Karma will.

I also operated under that assumption and unfortunately it’s wrong..

I got a judgement against me recently as I didn’t even know about it to defend.. it was served at one of my properties.. and that was good enough for them.. I was floored.. it’s since been sorted out thankfully..

Taun Bewsher (gmail account)

I can see you are not keen to post a copy of the reference. Anyone else had a copy of this sort of thing? And how did he find your email address?
