The copying could be said to be less blatant but the original design, in this case, might be considered more distinctive?

Also a storm in a teacup in my books... (and the ZARA ones were actually nicer)

But hey, we all found out about Makhosi socks - no publicity is bad publicity  ;)

Google 'Diamond Pattern' and you'll discover about 5million potential sock patterns you dare not use...

Thats what I would have done.

 

This is now the second time that this lady is causing brand damage for Versus.

 

They should leave the Social Media up to Hanno and Jurgens....

We should quit our real jobs and become social media influencers.

hmmm memories of that whole coffee machine competition debacle.

 

FWIW they're obviously aware of it, if they have a 'foot' to stand on , they could and would fight it .. maybe they are.

 

I own one pair of Versus socks (coffee one ) and one pair of the duck ones from the checkers range - TBH, there's not any quality difference that I can notice.

 

But I like my Falke and Stance socks more (and most recently Nandos ones) :ph34r:

The coffee socks comp left a sour taste in my mouth.

 

The stance socks are much better. Wearing mine right now.

That reminds me, I need to check my lbs to see if they got stock again..

Copying sucks, I know I’d not be happy if I were the owner of Versus or if someone profited off something I designed.

 

It’s a difficult thing to stop and in all fairness I’m not sure the buyers at checkers even realized the design was a Knock-off. Their reply to the original tweets was great and I hope it all gets resolved.

anyone remember team jelly belly, a cycling team with jelly beans all over their kit, socks included. 

Jelly Belly....my old nickname before cycling....!

you're assuming only one aspect under the term used which was "design copyright", which relates to both the materials and manufacturing quality also.

For example, Falke brings out a new sock design with "light", "green" and "breathable" and "moisture wicking" socks for runners, with a jelly bean design. They price this at R75 a pair retail and let us say R30 design, development and manufacturing. Cheapskate or copyright breachers see this new jelly bean design and decide to capitalise on the situation. They manufacture rubbish socks with the same concept at R3 each and retail for R10, then a local company buys them at R10 and resells for R40 for 2 pairs. Now Falke's design and sales would become undermined.

I don't know versussocks and also don't care to find out, but the concept still applies if they have any claims to copyright.

 

Hopefully after reading this you show some insight into why it is a problem.

Google chinese bepsi and mcdnalds etc and do some reading and learning.

Well then surely the same applies to Versus. Socks with jellybeans on them existed long before Versus designed theirs so would be quite difficult to copyright as a design.

If jelly bean socks have been around for quite some time then I don't see what the fuss is about, let the jelly beans flow. With that said, I have 3 pairs of Versus socks - the popcorn socks, the jelly beans and the coffee socks, and I'm quite happy with them. I needed a few new pairs of riding socks as a change from my 2 pairs of GT Bicycles socks that I was wearing from the days when I had a GT mtb.

I seriously doubt those socks are similar. They will have to prove the colour, the bean shape, colour pattern and fabric are exactly the same. Besides jelly beans are the most common pattern around alongside stripes, checks and diamond pattern

It most definitely does.

People need to understand this:

Ideas = cannot copyright this. the jelly bean on a sock is an idea.

Designs = can copyright this. if the designs look similar enough (colours, shape, size, whatever), someone can pursue the case.
