Sold, Previously repaired frame

Hi hubbers.

Opinion needed, Last year Oct\Nov I bought a bike from a fellow hubber, after 3 months of use I noticed a crack on the left chainstay. Thinking, okay this sucks but let me get it fixed.. after evaluation by a leading Carbon repair center I was told the frame is basically a paper weight as its been previously repaired (and very very badly- see pics attached) 

Do you think this is fair, should the seller carry responsibility?

Note; the seller basically claims no knowledge of this and refers the issue to the previous owner that's now immigrated.   

I know I should have paid more attention to evaluating the bike before payment but i trusted my local Specialized that everything was fine, they received the bike from CPT and assembled it, not blaming them or anything.

If anything I hope someone looking to buy reads this and takes a few extra moments to inspect what you're receiving.

IMO the seller and your local specialized dealer are both at fault.

Specialized SA are anal and in a super anal way about all their frames and bikes that they sell.

So much to the point all it would of taken from your specialised lbs to send a email with the frame barcode to head office in stellenbosch and they would of immediately got a full history report on the frame before you bought it.

Everything from what shop sold the bike,who was first owner,was the bike in a wrightoff or repairs.They keep that information on every bike/frame they ever sold.I was in the same situation buying a frame on the hub and went thru the process.

Specialized came back to me and could say bike was bought at X shop,was repaired by CBR on X date etc.

When I questioned seller about the bike been repaired he just told me that’s the first he’s ever heard about it…..

Second thing there are a number sellers on the hub selling “repaired “bikes and frames.I’m pretty sure they got a contract with insurance to buy back ,repair and re sell on hub.What really gets me is that they NEVER indicate in any of their adverts it is a repaired that is for sale.

My advice is get the mail off to specialized with frame barcode,get frame history,if you can prove seller knew it was repaired and didn’t tell you,take it further.

Side note,your specialized lbs probably didn’t want to go thru the check because you didn’t buy frame from them but they would definitely have done the history check if you asked them.

I can’t believe a bike shop built up that bike and didn’t see any of those cracks. Have you shown them the frame and BB to ask for their comments. Maybe you should ask for an eye test certificate from their mechanics?

I had insurance for theft and crashes on my bike.

then melted my wheel when it was hung in front of my exhaust on the bike rack.

insurance laughed and paid out no issues

If you took the frame to a certain carbon repair shop in CT then I am not surprised that they told you that. You're more than welcome to send me a DM and I will give you two other contacts that will be able to fix the frame. That is not "Un-repairable"

seems straightforward:

A: insure bike, don't inform of crack. then next week claim for JRA cracks.

B: bike is already insured, put in an honest claim saying you mistakenly bought a bike with latent defects that are only now apparent.

 

A = fraud

B = taking a chance, but nothing to lose.

 

edit: i would hope insurance companies in the bike sphere have got 30 minutes to do an online search before paying out, in scenario A the potential fraud would be easy to spot.

It's Fraud because the Damage was done many moons Ago and Hidden by Shoddy Repair.

The Current Owner Knows about the Damage and has been told that it cannot be repaired by Carbon Specialist.

He did not crash the Bike it Was Already Crashed by the Previous Owner.

 

So I buy a Crashed Car, I insure it.

I then claim from Insurance.

I Expect to go to Jail.

Think I’m going to give this a shot, I know the guys very well over here in Bryanston.
