Drunk driver - just hide and get away with it!

We T-boned a car last night which did a u-turn in front of us. Within minutes the driver, with her box of wine, was guided out of her car by the person who's house she had been visiting. She went into the house and her friend denied she was inside despite two witnesses confronting the home owner. Cops never arrived and eventually the homeowner signed for the tow truck to remove her vehicle. We did manage to get her name and phone number from the homeowner. About 90 min later we were at the police station reporting the accident when the driver phoned me, completely intoxicated, she wanted to know were her car is ! The cops were not interested in trying to find her last night so she will not have a drunk driving charge against her.

 

Just glad we are okay and lucky we were not on the road bikes when this excuse for a human being decided to drive on the roads

You should never allow a person to leave the scene of the accident! Happened to me once when a youngster came plowing through my front lawn and into my wall. There were so many people standing around and when I finally started looking for him, he was gone. He was taken to a friends house and then after 30 min came back to the scene. When police wanted to take him to the hospital to do the test to establish whether he was intoxicated (which he was), he refused and said he had something to drink for shock after the accident at his friend place :whistling: SAPS then agreed that doing the tests would be of no use- so he got away with it :thumbdown:

Can one make a citizens arrest to prevent someone leaving the scene? Cable tie the driver to his steering wheel?

 

Yes, I would think you can.

THE SOUTH AFRICAN CRIMINAL PROCEDURES ACT OF 1977, ACT 51, SECTION 42, says concerning an "Arrest by private person without warrant":

1. ANY PRIVATE PERSON MAY WITHOUT WARRANT ARREST ANY PERSON - (A) WHO COMMITS OR ATTEMPTS TO COMMIT IN HIS PRESENCE OR WHOM HE REASONABLY SUSPECTS OF HAVING COMMITTED AN OFFENSE REFERRED TO IN SCHEDULE 1

EDIT: there are many other schedule 1 offences, but I thought maybe this one could also be relevant.

AUTHORIZED TO ARREST

» Any South African citizens may arrest anyone who he/she reasonably suspects of having committed a Schedule 1 offense.

 

» Any South African citizen may arrest anyone attempting to escape a security officer, police officer, detective, or national security officer.

A Merc drove into me from behind one night in Fochville (hit my VW Polo). He/she fled the schene and never found the driver or the Merc. Luckily the insurance paid my Polo that was written off. :cursing:

Open a case and insist on the person being arrested. As far as I know it is against the law to leave the scene of an accident unless you are being taken to hospital. You have to remain at the scene of the accident if you were involved.

Hope you have the names of the SAPS and time that you were there. Complain the the Station commander, if that doesnt work then take it up with the Area commander. If that doesnt work the try the Provincional office of General Lamoer. :cursing: :cursing: :cursing:

If that doesnt work then nothing will, just thank the Lord that you guys are OKAY. :w00t: :w00t:
