No it's against the law. Illegal. You cannot sell fakes in SA. Even if you are open and upfront about it.

Oops sorry Dean should've said replicas and not fakes. Unfortunately, afaik, there's no law barring you from selling replicas as long as the purchaser is aware that it's a replica. Personally I would prefer it if it was illegal to sell replicas.

I just figured it out.

 

It's actually a "5-WORKS" by "5PECIAL1ZED"

 

And if you look carefully at the inside of the chain stay you will see this is the special UCI WCcedition STUMP-PUMPER.

Umm... it's a protected brand, if it's not illegal then it certainly is a civil matter that 'Craig' with phone number could be in the dwang, if of course Spez take it further... but my understanding is...ILLEGAL

People often use the term "replica" as a more PC way to describe a fake. In most cases it's still fake and disclosing that fact doesn't make it legal.

 

A true replica would be a licensed, legal product which looks similar to the real thing. E.g. A legitimate Springbok rugby supporters jersey would be considered a replica. Not a fake, but a look-alike of the real thing, produced by a manufacturer who has paid for the right to create and sell it.

My question is...what if the buyer of this frame decides to resell it either as a frame or complete bike..will he also specify this as a replica or will someone be cheated out of his hard earned money.

They took a guy to court over a name,would hope they take this further.

Afaik, the purchaser needs to needs to be aware that it's a replica for it to be a legal sale. Again afaik, rather obviously this does mean that I could be wrong re legality issues BUT Nayr I still think 'Craig' going to be on the receiving end of a lawyers letter.

anyone who knows anything about bikes will realize these frames look about as close to a Specialized as a GWM bakkie looks to a Isuzu bakkie. These look like cheap Makro bikes,awfull. If you buy them and rock up at a race, I will give you *** and laugh at your cheapness. Please know that.

No no, not at all. This is a great deal. The only reason we could find around the braai for buying a GWM was, Geld Was Min. I cant find any reason not to buy this.
