WTH respect let’s go through this together and keep it to the facts. You assured me payment was done instantly and must keep the goods for you. You said you would do a instant payment form same bank to same bank. The proof sent to me of payments were not recognized by the bank as legitimate a day later and dither proof two days later. It possible your intention at that time was not to pay me right away I don’t know. I then alerted you to the fact and then on the third day payment was received. I apologies for the bank not recognizing your proof of payment but the fact remains they never seen this type of proof ... The goods are in good condition, before they were packed they were also photographed. Further more I confirmed our discussion and noted the goods are sold as is in the letter with one pictures of the packed goods. There be no further comment and wish you happy riding.

You have a chance to restore your name, or what little is left and sort this out. From what I can gather, you are in the wrong here. MAN UP and give the seller the refund

So you're saying i used glue, black and white markers to conceal damage on the helmet i bought from you and did not use?

 

And i scratched the sunglasses i bought from you for R650? why would i do something like that?

In the letter you added in the box you said you tried to fix it. dont be a chop man up..

I've got nothing to hide.. The proof of payment i send you was from the Standard bank app. it gives you the option to send it as an image which i did.

 

I then sent you the proof of payment from the Standard bank online portal which also has the timestamp of the transaction. I Paid within 5min or so of speaking with you over the phone.

 

This could all be resolved if you answered the phone when i phone you or reply to the messages i sent via sms or whatsapp. Instead you want to email Bikehub and tell them i tried to defraud you. but you still had the items in your posession? what were you trying?

 

Why lie to me and tell me you opened a case of fraud against me with SAPS? you had my cash and the items. you made me run around looking for answers and didn't answer your phone or reply to messages when i asked what fraud did i commit when i paid you?

You had me running around trying to sort it out while you kept silent.

 

Get your facts in order. I buy and sell stuff on bikehub often. 

 

I gave you 5 days to respond to me before opening this thread because i believe in the good in people.

You're trying my patience now, stop trying to convince bikehub Admin i am a scammer.

Seems like you talk a lot of crap in the same sentence.

 

 

From your add, regarding the glasses:

 

“Glasses frame and lenses are an outstanding excellent condition”

 

So they went from Outstanding Excellent to F-uped with one shipment??

 

 

From your add regarding the Helmet:

 

“In good condition has new inside padding only about four months old”

 

What is four months old, the padding?  There is no way in hell that spoeg & plak helmet is 4 months old?

So there was some or the other mixup re payment. Banks do that, let's move on to the second and more pertinent point.

 

You say you photographed the goods prior to sending them. Share the photos here, with EXIF data to verify date and time. 

 

Then perhaps you can comment on the fact that allegedly you told the buyer that you opened a case (of what? Theft?) with SAPS. And afterward messaged that you had in fact not. 

 

Your credibility is in tatters. Present clear factual information or return the man's money.

I hate it when people try to hide obvious damage to make an easy sale. Be upfront and photograph the damage, state what caused it. People that are really interested in what you are selling will appreciate it more and will trust you more when doing the transaction.

OP, could you please clarify the following:

 

Did the seller at any point up to the time of exchanging money note that the goods are sold "as is", or did he just add this little gem with the letter in the shipment?

 

If this was never disclosed prior to the finalisation of the transaction when you paid the money, the it is a useless regulation..... the seller can not just willy nilly make up rules as he wishes without you both agreeing to them!?!?

Well if we are being strictly by the book the buyer doesn't legaly have a foot to stand on as second hand items are always sold "as is", and as such the responsibility of the buyer to inspect the items before purchasing.

 

However.... on Le Hub I think most of us (incl. myself) tend to give sellers the benefit of the doubt and believe the items to be in the condition advertised (something I never do on Gumtree). What the seller did here was quite simply dodgy and dishonest, but legaly he will get away with it.

 

Let's just hope he does the right thing, otherwise the buyer has unfortunately paid expensive school fees.

personally, I don't see how anybody can buy something without inspecting it first. You're setting yourself up to be shafted.

 

I am not excusing the seller in this case in any way. Just a general observation.
